Movie Company Sues Pirates Who Used an Anonymous VPN (PIA)

The makers of the film 'Angel Has Fallen' have filed a lawsuit against seventeen alleged pirates. According to the complaint, several defendants used the VPN service 'Private Internet Access,' which can expect to be subpoenaed. That effort will likely be fruitless as the VPN doesn't keep any logs. However, with help from information shared by torrent site YTS, users are still at risk.

Such a setup seems secure, but it hasn’t prevented the makers of the action movie ‘Angel Has Fallen’ from suing several anonymous VPN users. In a recent lawsuit filed at a federal court in Colorado, the company lists fourteen alleged pirates that used an IP-address of the VPN service Private Internet Access, also .

“Upon information and belief, Defendants DOES 3-5, 7-10 and 12-17 registered for paid accounts for Virtual Private Network (‘VPN’) service with the Colorado Internet Service Provider Private Internet Access,” the complaint reads.

The lawsuit in question lists the defendants as Does, which means that their true identities are unknown. However, attorney Kerry Culpepper, who represents Fallen Productions in this matter, hopes to find out more through third-party subpoenas.

TorrentFreak contacted PIA for a comment on the lawsuit. The company said that it hasn’t received a subpoena yet and reiterated that it can’t identify individual users.

“Private Internet Access has not received a subpoena in regards to this case. Even if we do, our response will be the same as always: PIA does not log VPN user activity,” a PIA spokesperson informed us.

That was also confirmed in more detail earlier this year in our annual VPN overview.

“There are no logs kept for any person or entity to match an IP address and a timestamp to a current or former user of our service,” PIA said at the time.

That said, defendants are still at risk, as their email addresses are known as well. That doesn’t prove anything, as YTS allowed members to sign up with a fake email, but it could lead to people being identified eventually, without PIA’s involvement.

If anything, this case shows that using a VPN only offers limited anonymity. When people use a VPN irregularly and leave other information behind, such as email addresses, they may eventually be exposed anyway.

 

So ether these guys didnt have there there VPN turned on or PIA is acting goofy again... will be interesting to see what happens seeing as I and I am sure others on this forum uses PIA.

This will be very interesting, especially if PIA gets subpoenaed which will ultimately say whether they log and what other info they keep.

I don't understand, how's PIA supposed to protect you from using your email-address to log in to sites? I don't see literally anything that'd be somehow PIA's fault here.

Pretty sad that they feel that because of their ailing movie franchise that they need to sue to get money from people who probably won't end up paying anyway.
Waste of time, money, and resources.

A VPN is a tool, just like a hammer. It's not on the hammer maker to tell you exactly how to use it. You should do your research on the best hammer techniques, and what to avoid doing. The hammer maker may design their hammer to be used with the head, but if you don't know how to use it you may hammer with the handle. In both cases the hammer does its job, but one way is more dangerous potentially, and inferior. The burden is not on the maker, but on the consumer to decide what the best way to use the tool is. Of course, it's nice when the maker does provide guidance, but it's not required nor should it be expected

Well no shit. Any decent pirate would look at PIA for 3 seconds and realize it's worse than having no VPN. RESEARCH RESEARCH don't be lazy

Movie industry is a dying dinosaur. I've complained many times that if I could stream blockbusters for a fee, I'd watch a lot of them. You won't get me to cinema. In the middle of effin Europe. So, yeah, you can imagine where I got it...

 

I always compare movie industry to games industry and how things change. Games, they are mostly digital now and getting them is so effortless and easy I simply can't be bothered pirating them. I just can't be bothered to look for a working copy and deal with cracks and patches. I buy it on GOG or Steam and minutes later I can play it. It's so easy I haven't pirated any game for at least 15 years. Basically since Steam happened. I was buying some games in retail, but they were often hard to obtain. GOG and Steam, not so much. Especially GOG for older, long gone titles. Movie industry needs to step up. Not to mention I prefer to watch it in peace on my TV, on my own terms at my time of choice, not be bound going 20km to nearby cinema, be forced to watch it at certain time and then having to deal with idiots who either can't shut up or who have to make everything smell like a god damn kebab stand. So, there's that.

I know they've been subpoenaed before. I don't think they have after Cape Tech. acquired them though, which is what I'm interested in seeing (policy changes). 

And yes, VPNs are not as important as people make them out to be. In fact, I'd say for the vast majority of people they weaken your defense. IP tracking is not widely used. Fingerprinting, social media trackers, and analytics are all used a ton more. This forum has google analytics, along with amazon ads which uses some tracking (cookies namely).

So, in a nutshell, the VPN worked as expected. The usual way copyright trolls law firms hired to hunt random pirates find them is by downloading torrents themselves and registering the IPs and whatever metadata of the people they obtain file parts from. The reason why a VPN blocks that process is because all they get is the VPN's server IP, but can't identify the end user. Hence, the quoted bit above means this is business as usual as far as the VPN goes.

 

Not sure if they truly have anything else on these particular users somehow, or this is just a publicity stunt to dispel the aura of immunity that VPNs enjoy among torrent users. Or if they're preparing to go Mega Upload on them after requesting the users' ID, you know, the old "fuck what the laws say, we're crushing you anyway".

But without further information, sounds like a run-of-the-mill dead end.

Some torrent programs will send out both your actual IP and your VPN IP, but only the VPN IP will show any traffic.

And yes, VPNs are not as important as people make them out to be. In fact, I'd say for the vast majority of people they weaken your defense. IP tracking is not widely used. Fingerprinting, social media trackers, and analytics are all used a ton more. This forum has google analytics, along with amazon ads which uses some tracking (cookies namely). 

 

Also, thank you for that test thing. I didn't ever think to use something like that.

A blank slate of a computer, fake email, Mac spoofing and a public hotspot (even better in the age of masks, just keep identifying info/vehicle well away) would make tracking down a pirate an expensive endeavor. You don’t need a powerful machine to download torrents. Something small, cheap and discreet (IE, common and forgettable) works well. Long battery life is much more important than processing power. Easy to close up and walk away at a moment’s notice. 
 

I hadn’t tried this myself, but I wonder if Deep Freeze could reset a spoofed Mac. Download pirate booty to an encrypted USB. Shut off PC. Once it’s booted, there’s no evidence of the offending Mac Address at all. And would make it trivial to start with a blank web browser slate.
