If you pirate a film, it's the ISP's fault, not yours

In an interview with CNET Australia, the co CEO of Village Roadshow, Graham Burke said that if you pirate a film/game/etc. it's the ISP's fault, not yours (wot).

Quoting Burke; 

 

 

"iiNet are selling a car which happens to kill people on the roads, so they should be paying towards that," said Burke. "It's the car that's faulty. In this instance it's the fault of the car, not the driver.

That makes no sense....

"They're providing a service which enables people to steal other people's property, so...some of the costs should be theirs. Equally, the copyright owners -- of which we're one -- stand to gain, so the cost should be shared in some equitable way."

So if I work at a hardware store and sell a customer a crow bar and he happens to break into someone's house and steal things, it's automatically my/the companies fault for providing the utilities to commit the crime... seems legit. 

I would write/discuss more but some my brain cells just committed suicide so it's a tad hard.

The ISP can't block EVERY torrent site. There is thousands of them.

To be fair regarding his automobile comments, General Motors have been killing and maiming hundreds of people for years now due to faulty manufacturing and design flaws in their shitty cars.

Piracy, porn and self diagnosis keep the internet in Australia clicking over.  Our ISP's are not going to do anything about it.  In fact I wouldn't be surprised if they start "losing" log files if they make too much noise.

 

Although having said that the general connection speeds are not as bad as everyone makes out.

Not in that way, but providing preventative and reactionary measures to counteract illegal activity is their responsibility.

 

In the UK it's up to the ISP too, they just get called lazy.  They do implement blocks to sites at the request of the government as they did so recently with Kick Ass Torrents, Pirate Bay, Isohunt etc.  They constantly receive criticism from politicians and the public for not being proactive enough about CP, piracy, drugs, cyber-bullying etc.

 

I'm not defending it, so don't get me wrong!  I'm just playing Devil's Advocate.  Piracy and theft is a crime, as is child pornography, as is selling narcotics.  They're not the same crimes, but they are still illegal.  It's not the ISP's fault, it's much larger than that.

 

Morally and ethically I have trouble agreeing with ISPs policing activity.  But I'm also no expert.  I'm all for all data being treated equally and anonymously, but I'm not blind enough to ignore the potential flaws with that view.

 

P.S Devil's Advocate isn't a terrible movie.  Would recommend watching.  Keanu Reeves is pretty good in it. If you can't find it on Netflix it's probably on The Pirat....

Weapons in general are a different issue.

There's intent in the making and design (design) of a weapon.

 

A crowbar has legitimate uses, a gun, as much fun as it can be to shoot at targets (I know it is), ultimately is made to shoot living things (indeed why would you shoot something else).

 

If I can avoid killing another living sentient being I'll do it. (including what you would call meat)

I think they have a good point. Though the car analogy they used doesnt work at all.

 

Imagine if you and another person are driving in a car. You are sat in the passenger seat, and the other person is driving the car. The driver of the car takes instructions from you, and follows them without question, and does only what you tell them to do. What if the car hit and killed someone. Who would be at fault?

 

Somebody is at fault when it comes to downloading copyrighted material illegaly, and its up to the courts to decide who is at fault.

But that's exactly the kind of fucked up logic the anti-gun nuts try to use to justify taking guns away from law abiding citizens. A drunk driver kills someone, they blame the driver, not the car. But if someone shoots another person, the blame the gun and try to claim all guns are evil. They want to be able to go after the store that sold the gun and the manufacture who made the gun. They have even gone so far as to encourage other people to make fake calls to the police in order to get legal gun owners murdered by the police. They tell people that if they know someone who owns a gun, they should call the police and say that person tried to kill them with their gun so the SWAT team will show up and raid their house in the hopes that the shoot the owner during the raid.
