Apple loses iPhone trademark battle in China

Well - I too would be confused if I was looking for an iPhone handbag by Apple.

Apple first registered its iPhone trademark for computer-related goods in China in 2002, according to the Legal Daily report. Such registrations apply only to narrow categories of products — and in the case of iPhone, Apple didn’t specifically register the name for leather goods.

That means that while the court’s decision is something of a blow to Apple, it isn’t likely to affect its sales in the world’s largest smartphone market.

Generally speaking, to succeed the mark needs to be widely known to the general public in China. And in October 2007 — two years before the first iPhone was sold in China — the mark “iPhone” was not well-known to China’s general public. Accordingly, Apple was held to have had no basis to invalidate Xintong Tiandi’s trademark application.

I know, i wasnt being particularly serious though they could potentially move manufacturing to the US like the Mac Pro

but there isnt the factory space, nor trained workforce currently available in the US and it would cost.. A LOT

Well Apple kind of fucked up. Several years before the iPhone was introduced into China, the leather company trademarked the term in the specific "leather" category. Apple should have trademarked the term in all 45 categories, like Starbucks did.
