Microsoft behind buying out its domains with .porn and .adult domains

GoodBytes

ICANN have released many domain names in the recent past year. Domains like .xxx, .porn, .adult, and even recently .sucks (avail June 1st) and charges 2500$ for it. Companies are now buying all these domains to protect their site, bringing massive money to ICANN.

Microsoft buying .porn and .adult domain names already, and probably more to come. CNN Money reports (via Neowin), it doesn't stop with companies, celebraties are doing the same.

According to CNN, celebrities such as Taylor Swift have also made moves to secure the soon-to-be-available .porn and .adult sites to avert an image crisis as well, before anyone gets a crack at buying out these domains.

Hell seems like just adding more domain extensions can be widely profitable for them. Well expect to see 1000's more in the next year or two.

Am I the only one who thinks people (and companies) shouldn't have to buy domain names in order to prevent their name being used by another entity?  If a domain name can be ceased in the name of piracy then surely it can be ceased for naming copyright.

There are companies from different regions though which happen to have the same

name because either they don't compete with each other, or because their markets

don't intersect geographically, or not? We currently have a court case going of

a trade association whose acronym happens to be identical to the new acronym of

our national TV station, for example.

How would one determine who gets the domain in such a case? Firsties? Auctioning?

Agreed though, it does seem a bit absurd. "Sure, we'll pay you tons of money so

that our name doesn't get dragged through the mud." (which to me seems possibly

more of an issue with .porn and .adult than straight-up copyright/trademark

violations).

Though, also the other way around: What if I'm a small regional business but I've

managed to grab a domain for a multi-national company who happens to have the

same name? Presumably I'd be at a rather serious disadvantage if they could start

seizing domains, even if I won in the end it would probably still be very arduous.

Sure I'm also at a disadvantage now if they decide to sue me, but if they can just

seize the domain outright, the fight would probably be even more one-sided.

Personally, the problem I have with ICANN decision is that it hurts the small business who can't afford all these domains.

Sure, it is easy to say "don't suck then", but you'll always have someone angry or unhappy despite ones best effort.

Awww, I was hoping to read that Microsoft is getting into the porn biz.

Why on earth would you want that? They'd find a way to buyout stuff like pornhub and our free porn would be gone.

I guess my immediate thoughts were, if you are registering a .porn or .adult site then you are not a legitimate competing business as such. By registering taylorswift.xxx it is fairly obvious they are capitalising on or trying to defame taylor swift (unless the site owner can prove their birth name is taylor swift).

Yeah, if you're a small business you can kinda get stuck in the mud on this one. :(

Good point, yes. I suppose the important part would be to put a decent control

mechanism in place to administer the thing.

If the domain's owner has no legimate use for the domain, I don't think so.

It can lead to funny situation, though: http://steam.com/

Don't even get me started with company names that mean real things, like Apple...
