AT&T just got hit with a $100 million fine after slowing down its ‘unlimited’ data

The Federal Communications Commission slapped AT&T with a $100 million fine Wednesday, accusing the country's second-largest cellular carrier of improperly slowing down Internet speeds for customers who had signed up for "unlimited" data plans. 

The FCC found that when customers used up a certain amount of data watching movies or browsing the Web, AT&T "throttled" their Internet speeds so that they were much slower than normal. Millions of AT&T customers were affected by the practice, according to the FCC.

 

The fine, which AT&T says it will fight, is the largest ever levied by the agency.

AT&T implemented the practice in 2011, prompting thousands of customers to complain to the FCC, according to an agency statement.

By not properly disclosing the policy to consumers who thought they were getting "unlimited" data, the company violated the FCC's rules on corporate transparency, FCC Chairman Tom Wheeler said in a statement.

"Consumers deserve to get what they pay for,”  Wheeler said. “Broadband providers must be upfront and transparent about the services they provide. The FCC will not stand idly by while consumers are deceived by misleading marketing materials and insufficient disclosure.”

Many of AT&T’s unlimited customers have 4G LTE service, which typically provides mobile Internet speeds of more than 30 megabits per second. That's roughly 60 times faster than the speeds experienced when AT&T throttled subscribers, who were slowed to speeds equivalent to dial-up, according to a senior FCC official.

But consumers are unlikely to receive any money from the fine, which will go instead to the U.S. Treasury, said the agency official.

Bandwidth throttling is the intentional slowing of Internet service by an Internet service provider. It is a reactive measure employed in communication networks to regulate network traffic. This is really bad.. We are paying for a service and they are looting off our money without providing the promised service.. Hope this will be a lesson to all. I am sure, they will appeal.. Hope in the ongoing legal battle, supreme court full bench will be in favour of consumers..

This might set a precedent in Australia....Optus does the same thing with a "fair use" limit on their "unlimited" ADSL....which is meant for large households with shitloads of people using it.

Either don't offer it if you can't provide it, or make it happen, but don't lie and say you offer 1 thing when it's actually another.

Oooh, so glad to read this, puts a smile on my face. No actually, this makes me straight up hard. It's pocket change for them but AT&T will act like they are now considering filing for bankruptcy because of the lost profits.

This is LTT. One cannot force "style over substance" values & agenda on people that actually aren't afraid to pop the lid off their electronic devices, which happens to be the most common denominator of this community. I believe fair use clauses are pretty common across the globe. Here in England our ISPs are generally very good but the large majority of them do impose fair use onto unlimited Internet however most do it differently. They generally throttle everyone during predefined "peak time hours", they don't generally throttle because of amount of usage (though some do). I believe our ISPs were required to define what exactly "unlimited broadband" meant a few years ago so customers wouldn't be confused by the term.

Don't all "unlimited" plans throttle after a certain limit has been reached? How is ATT different from other carriers? Smells like the FCC is targeting ATT because they're opposing the "net neutrality" FCC power grab, now with a money grab.

We had that speed throttle for unlimited data traffic for years here in Serbia (which went from 7Mbps to 256Kbps).

That has changed, so now we don't even have an unlimited data plan, now we have caps ranging from mere 20MB (yes, megabytes) to stupidly high 10GB.

It's a matter of the carrier being transparent with their customers about the services.  FCC says ATT is not letting customers know up front that various "unlimited" data plans include throttling at whatever cap they determine.  It's a pretty slimy thing for AT&T to do.

Splicing fiber is actually easy as ever now days. Ask any installer whom has done it for a while. The newer methods of installing are 1000% easier and faster. The issue is Joe Gorrilla can install copper, but noone is gonna trust him to touch this expensive ass fiber.
