Because Fortnite would ruin them, they can revoke the Epic license they gave them and they'd have to move to another game engine which could do severe damage to PUBG.

I don't think the absence of a Fortnite lawsuit is as simple as "Epic could cut PUBG off at the knees."

 

There's no question that Fortnite's battle royale mode wouldn't exist if it weren't for PUBG, but it's also obvious that only the basic concepts, which PUBG itself borrowed from other games, remain intact.  The setting, equipment, and many of the game mechanics are significantly different.  Epic intended to ride on PUBG's success; it didn't set out to copy PUBG.

 

That's what this new lawsuit is about.  It's not just that this clone is a battle royale game, it's that it's clearly, intentionally aping specific parts of PUBG.  There's a much stronger case here.

PUBG Corp. has filed a lawsuit over two of its clones called Rules of Survival and Knives Out made by Chinese developer NetEase. PUBG are asserting that the use of "Winner Winner Chicken Dinner" oh and very amusingly, a frying pan. Yes, I'm not lying, on page 62, they're trying to argue that a frying pan can be used as a legal offence over the company. (Pictures will be included at the end)

This is just very silly, yes they're actual clones, sure but some of the claims are rather silly, a frying pan? Really Bluehole? Come on, you're better than that. You're hardly an original concept but I won't go into that whole argument.

 

PUBG Corp has asked the court to award damages and to have NetEase blocked from operating either game any longer. Bit extreme. Finally, they included an actual frying pan meme in their lawsuit

So, Valve should be able to sue the PubG company for using a frying pan because TF2 has a frying pan in it and has had a frying pan in since before that shitty game existed.

I don't like battle royale games but at least Epic is actually trying to make a good game with Fortnite. pubg, they're just lazy

Not in that actual context though. Claiming it was in response to players wanting a less laggy experience and less cheaters is the most calm way of putting it thats not how the players were going about it. There were Thousands and thousands of racists F the Chineese region lock them Comments for this. His response was a PR thing imo  for two reasons.  1. No one running a company will ever get behind thoese type of racist comments and pitchforkers (even if they had some vaild points)  and 2. More then half there playerbase is Chinese 

 

Pubg/ Bluehole has been pretty bad at PR at times. There very random one week they do awesome really open and takes feedback and does an update then they will just forget about the players ignore em and tell us nothing. its like a switch IDK why they havent learned by now that when they turn that switch off everyone goes nuts.

I wouldn't get hung up on the frying pan. The "Winner Winner Chicken Dinner", oddly enough, is a big issue. It shows a clear level of Intent to copy the IP of PUBG. That makes the frying pan an IP infringement, as it wouldn't be there if it wasn't intentional.

PSO ep1&2 had a frying pan weapon.  It was a rare weapon too.     And, it sounded like a frying pan hitting someone really hard when you used it on enemies.  Does that mean SEGA can sue them?  Considering PSO dates back to the Dreamcast era.

 

I remember for giggles going through Ultimate difficulty level online with just that pan.  Bang bang bang (seriously, that thing had a loud game sound).

It's not having a frying pan that's the infringement; it's the fact they put the frying pan in specifically to copy PUBG's IP. PUBG's lawyers aren't being obtuse with the frying pan bit. PUBG doesn't have exclusive rights to "frying pan" or using it in a game. What they do have is IP around the "PUBG" and other examples of intentional infringement change non-infringement into examples of clear Intent.

 

If you made a game called "GOOM" with the Space Trooper firing a Big Amazing Gun, iD's lawyers are going to on top of you pretty damn fast. iD doesn't know the IP around BFG (as I believe the name comes from the 1930s), but use of something like the BFG in a game that's already shown explicit attempts to copy your IP is, itself, then an infringement.

The issue isn't the mere inclusions of those.  It's that they were included in a battle royale game designed to clone PUBG.  Think of it this way: if you start a fast food chain focused on double-patty hamburgers and fries, McDonald's can't sue you just for that.  However, if you call your burger the "Mig Bac" and have a mascot who looks eerily like Ronald McDonald, McD's lawyers will want to have a word with you.

it's a frying pan....and a generic phrase. "Mig Bac" is a play on words of Big Mac, so sure McDonalds are not going to be happy. but it's a frying pan. how many shooter games have an AK47 or M4 in them? should they all be suing each other for have the same generic weapon in them? no. Just because PubG became popular doesnt mean they own a frying pan in a "battle royale" game mode.

I get people are very tired of the Battle Royale thing, but I understand the legal issues. Someone else is making money off of Bluehole's work, despite any issues with PUBG.

 

There are a lot of clones, and I think the mobile market has some of the biggest issue with copyright violations. PUBG aside, how many Star Wars games can you find that aren't officially licensed? Does it make it ok to use Lucas Arts and Disney IP?

 

Just because people don't like the game or the concept doesn't mean that mobile developers should be able to copy and profit from others.

 

There are plenty of other clones out there aside from NetEase.

 

 

nobody gives them the benefit of the doubt due to them throwing shade epic's way/made threats pre FN launch..epic, who literally made the engine their spaghetti code runs on and could've revoked their rights anytime.

 

Now, I am sickened by the mobile market, the clones, and the large companies like king that sue the people they rip off of, but this isn't the way to go. This is PR suicide, but their pr is so bad they have nothing to lose.
AS SOON as a good PC battle royal game comes out that's similar in style to pubg, they will lose share fast. PUBG isn't a good game, it's the first. It's the go-bots to the transformers. Instead of fixing their broken ass game they make a mobile game which, btw, I've have found is more playable than pubg on xbox one.

 

I throw so much shade because the amount of money they made from this game initially was massive, and they have basically missed their oppurtunity to not only fix it, but lock their place in the market. And I know full well that with what they made, they could have hired massively and remade the entire game ground up by now and still not touched a large portion of that money. A game like this is easy and cheap to make, especially since a large portion of the assets iirc are ones they just got rights to and dumped them in. A team of 5 or 10 could make a game like this given they have the budget to buy rights to things, and do a better job. Not perfect, but better. And it's understandable that their first draft was like that, like a small incompetent team made it. With that kinda money, anyone could have done better. You can literally outsource the problem at that point.

When I say pubg is bad, I don't mean it can't be great. I think it'll just be dead by the time they'd get there at this rate. They know it. IP abuse is the only path forward in their mind. They will go down kicking and screaming. They'll see a decline and spend several times on marketing what it would have taken to just remake the game, and eventually run out of money or margin to fix the real problems. They've lost their chance and you can't even blame greed, or evil. Incompetence is the only answer.
