Lofi Girl live stream taken down after abusive copyright claim

Summary

After more than 20,800 hours live, Lofi Girl live stream was taken down on saturday, July 9, 2022 because of a false, abusive copyright claim by Malaysian recording company "Fantasia Music City" (FMC Music), which generated a strike on the channel and took down the live stream. Because of the strike, the channel wouldn't be able to live stream for 90 days.

A day later, on monday, Youtube team responded on twitter claiming that the issue has been resolved, the claimants account has been terminated and that everything should be back to normal in 24 to 48 hours

My thoughts

Even though YouTube has solved this quickly this time, It shouldn't have happened in the first place. Companies being abusive with their copyright claims is becoming more and more of a problem on the platform, see what Nintendo is doing to videos about Switch emulation on the Steam Deck. Also, as you can see on the twitter thread, a lot of small content creators have had problems with (allegedly) false claims and YouTube has never lifted a finger to help them.

I'll never forget about a video I saw where the creator made a simple jingle and registered it on a music distribution platform, so he can copyright claim his own video and protect himself from the system (since that way he'd be able to receive the revenue from the copyright owner: himself)

On a more serious note, I prefer RelaxBeats to the cringe that is the aforementioned channel (and its even more cringe discord).

I was afraid this is what happened. I wondered why the stream ended.

 

Seriously, listening to Lofi Girl their music is the same several songs on loop which is understandable given how cut throat the music industry is when it comes to copyright. If the channel can't even play a select series of songs without being attacked still then it's a horrible BS system but I'm glad to hear it's being resolved.

 

This isn't the first time their channel has been suspended either. Last time I remember it being taken down was because chat got too carried away and started talking about some very bad things.

A false claim was made, it was researched and everything is okay again?

 

That's how the world kinda works.  If I make a claim against you, the police come and sort it out and then you on your way after it's determined I was an asshole.

The problem is that the "police" in this case only work with you if you're high enough profile. If you're a random person on YouTube, and someone abuses the broken DMCA to take you down, you're just done. There's no help for you. YouTube just terminates your account and tells you to go fuck yourself.

@LouKsidk what you want from youtube. They are legally obligated to address copyright claims and then they can take the time to look into it. They would be legally liable if they didn't address the copyright claim and it happened to be legitimate.

So if he copyright claims his vid then companies cant copyright the vid cause its already claimed?

You might be surprised how reliable even a crapper-tier Linux distro like Mint is when it comes to redundancy. It updates itself on the fly for the most part, the majority of the updates doesn't require restart, and the other Windows tidbits simply aren't there. That's why they're so common in file servers. They're also probably connected to a service like Cloudflare that is actually reliable on the long term as far as connectivity goes... so, it's actually somehow plausible.

Reminds me of video of mine that was claimed twice by two completely different claimants.

And the thing is that the latest DMCA claim overrode the previous one.

It's bizarre that you can override a DMCA claim with a new one.

You can copyright anything you legitimately create, so yes.

 

The issue is when all these YT folks make use shit already created to try and make money on, or provide a service that normally requires leasing or renting other content.

Yes, they should abide, but they also should provide support when things are reported as false/erroneous claim. While the Issue with this big channel has been resolved, a lot of smaller channels don't get support and end up losing their channels or ability to stream, again, see what nintendo is doing (as Linus said in the WAN Show).

Kind of, he still has to share the revenue with other companies, but at least he gets a slice of it. Corridor Digital once did a video about how they don't agree 100% of the revenue should go to the copyright owner, but a 50% slice would be more acceptable since audio IS 50% of the video experience. well, I don't know if it was uninterrupted, apparently it indeed was, but if it did get interrupted, it was for just a couple of minutes.

Coincidentally found that vid and watched it already, apparently you can abuse it so you dont even need yt partner program to make money

 

Theres also just copy claiming yourself multiple times but prob not worth it after 2 times

 

Lmao yt so broken you can copy claim your own vids and bypass ytpp and get half or more (depending on how many copy claims you put on yourself) of the revenue vs a company copy claiming your vid

 

Welp i guess if i make a channel i should also copy claim myself to nuke the system and even bypass ytpp

Well then they have a beef with the current state of copyright laws as they basically necessitate this method so as to not be held legally liable. I'm not saying it's ideal but I do realize that youtube doesn't have much of a choice.

More info is needed to see who was copying who.  Lo-fi might have been playing tracks which contained samples of music from FMC that they had no idea were pirated.

As already mentioned, yt has to cover their asses so as to not get dragged into court.  There are tons of pirated works on yt and they have to investigate claims.
