Am I the Asshole?

Hey guys,
My GPU has been sent to be repaired since it was still under warranty. it's a gigabyte 2070 super. After sitting for a few days at the shop then finally get sent to the local gigabyte distributor for more testing, they decided the gpu is beyond repair. they also don't have any other 2070 super in stock so they gave me 4 options:

  • upgrade to 2080ti for 800$
  • downgrade to 2070 for free
  • switch to rx6700 xt and pay 300$ (i dont even know what that is)
  • wait 4-5 months to get a new 2070super

now i get there's no stock, it happens i guess, but my options are pay 800$, downgrade, or have no gpu for 4-5 months. i feel like it's not my problem they are out of stock; they didn't have a support for their 3 year warranty products. i feel like upgrading to 2080ti is the only option because im an editor and need to work and I don't like the downgrade, but it’s not worth 800$, in fact I don’t think I should have to pay anything. They threw in 3 year warranty as a gamble and lost, they should be accepting their responsibility.
Am i the asshole for implying my options aren’t good and that I should have to pay anything for the 2080ti?

$800 for a 2080Ti is moronic and you're definitely in the right to be pissed. At MOST I could see them asking for maybe $200 or something but nearly 70% of retail value at launch is just no even with the shortages.

Why didnt they give you an RTX 3070 option? Also paying $800 for an out dated card is a bad idea your better off taking the 2070 and flipping it and using the $800 on a 3070 or 3080

You are not the asshole but there is always that fine print that nobody reads in you warranty card. 

Usually there is a paragraph about special circumstances where the standard warranty is no longer applying so they can postpone it for couple of months.

 

Don`t forget these fine print letters are usually written by layers not the sale people.

You loose big with all options.
But the market is what it is. If you have strong consumer laws in your state, you should sue your vendor. He should upgrade you for free with the 2080ti

But realistically, the less harmful way for you is to go with the 6700xt or the 2070. If you are not too attached to Raytracing and DLSS, the 6700xt is not a bad alternative.

For free, this would be a fair option.
The benchmarks are about the same:
UserBenchmark: AMD RX 6700-XT vs Nvidia RTX 2070S (Super)

So if you don't get the RX6700 for free, it's the best option to wait 4-5 months to get your 2070S.

(Maybe you get a graphics card for the time in between?)

If you take the RTX2070, you should get 120 USD for the difference.

 

And the last option should always be to get all your money back if they cant deliver a RTX 2070S.

Issue is op is an editor and amd cards are just not at all as well supported for acceleration in a LOT of applications or just straight up don't work right so the 6700xt is not an option here.

Had a similar thing happen with Sapphire. Refund, downgrade to RX 570 or pay 300 for a 5600 XT (old GPU was 5500 XT). I asked if they have some refurbs and they had some. You could try that. Maybe you can also try asking for a 30 series.

 

If you live in Europe they are legally required to give you a different 2070S or better or refund (which I wouldn't want with current pricing). Just threaten them with legal stuff and they should give you a similar or better card. In this case you should get a 3060 or even a 3060 TI

The rule is if they can't give you back a card of the same model is to get the next better thing for free (broken 2070S to say, working 2080 or at least a cooler upgrade) or refund what you paid for the card. I dont know when you bought the 2070S, but I imagine you can't even buy a 2070 or equivalent today with that refund money.

 

If you have time, try find out who's covering the warranty. Is it the company who made the card, or is it the retailer. If it is the company with the big name, insist that they have to give you the next better thing for free. Warranty is after all a promise that you don't lose anything if the card stopped working normally during that period and they are big enough to be hurt by negative reviews and legal actions.

 

But if it's the retailer covering the warranty, just take the 2070 for free. Negative press is less of an issue to them so it's harder to put pressure. Plus smaller shops might just close down

This the EU is very good in this I've used this MANY times for myself and others and for example the first time ever was with my hd 7870 xt that got a dead fan and I got on sale as it was already replaced. They could do a r9 270x but that would be worse so I managed to push em to a 280 but ended up paying 50 more for a working but refurbished 290 with the remainder of my 3 year warranty.

I would go the F off in your situation.

The product they made didn't live thru the warranty, it's on them to replace it. The no stock for 2000 series cards is fine, replace it with a current gen card of equal performance/price 

No cpu mobo or ram atm

$800!? To get a new card even though your under warranty? Then they want to tell you to downgrade for 'FREE' to a 2070 when they could reimburse you for downgrading. What a joke. What company is this? I'll know to avoid next time.

Also, if you have to pay $800 to upgrade to a 2080, go with the 2070 brand new. Don't open it, and resell it on e-bay. Take that profit try to get a 3060 ti, and pay the small difference.

Either way, this ends in phone calls and emails to Gigabyte from me. If this is one of their official distributers, give them the chance to make it right. If they can't/won't, then that's on them too.
