Adobe - stop using ‘Photoshop’ as a generic term

I am locking this thread as it is misleading and just getting people heated up over nothing.

 

Adobe is not asking people to stop using Photoshop as a generic term, they are not actively trying to change the way people use the word.

 

Someone just found that clause buried in Adobe's legal documentation and is trying to make a big deal out of it. This is a standard legal clause all companies must have to protect their trademarks, otherwise if Adobe officially allowed the term "Photoshop" to be used generically then other software could be legally called "Photoshop" software. Adobe doesn't really care if you use the term Photoshop, they just can't officially endorse its generic use.

PS. Photoshopping is a hobby and an art form.

Yay for retarded american trade marking laws. After all, they will lose the right to the name Photoshop, if it becomes a generic term. It might have gone too close to that already, since they released this crap.

Why does no one get this?

 

They aren't doing this because they think they can stop y'all from saying "I photoshopped it". They're doing it because by American Law, they have to protect their trademark, or lose it.

 

This is them "protecting" their trademark.

 

Otherwise, once it becomes a "generic" term in the eyes of the law, competitors could start to use the term themselves.

Moved to General Discussion. This is not a news article or announcement from Adobe, this is just someone digging through the legal documentation and finding something they think is a little funny.

 

This is quite commonplace and a standard clause for any trademark. NVIDIA has similar documentation specifying the only correct way to use the NVIDIA company name is in all caps, not Nvidia, nVidia, or any other variations. Likewise "G-SYNC" should always be in all caps. Does anyone seriously think NVIDIA cares how people spell their company name in regular conversation? I don't think so.

 

Legal definitions like this in practice are really only there for reference for other companies when they publish official statements or specs of their computers, or list features or software from another company, etc.

They're not pissy. Read what Glenwing wrote on page 3. 

 

Nearly every company worth its salt has a style guide to explain how their name and vocabulary is used. It's not picky, bitchy, pissy, or any other reflection of negativity in a marketplace.  

 

They're defining their product and the product name, but they're not openly lambasting customers for saying what they want.

Agreed its like velcro, hoovers etc they are brand names but people use them as generic terms

Almost as silly as saying "Hey check out this image I enchanted using Adobe® Photoshop® software!".
 
Whenever I see someone using ® or ™ in a post I immediately think "yep, that person is a shill".

Gimp is better, but in the eye of the consumer, Photoshop is better because it is paid.

That's not fair to ps (I feel so evil), it DOES have features that gimp lacks or doesn't do as well - depending on what you need that may or may not concern you (for 99% of people gimp is more than fine of course).

GIMP is better for many reasons, first of all it's free, features almost everything that photoshop has, is easy to make plugins for, is more logical to use and is libre
