New U.S. Federal Surveillance Rules, Similar to U.K., Come into Effect Tomorrow

Similar to the newly enacted UK legislation, Investigatory Powers Act, Rule 41 seeks to further expand the surveillance powers of intelligence agencies.  The rule would further erode Fourth Amendment protections as warrants can be applied to large swaths of devices rather than a targeted device.

The primary concern is the potentially overextending power the rule would grant judges issuing search warrants. The rule could be used to issue remote access warrants that would allow the FBI the ability to hack devices that are physically located out of their jurisdiction or overseas.

 

On a more fundamental level, privacy organizations like the Electronic Frontier Foundation (EFF) and Access Now believe the rule may present a threat to just about anyone using basic privacy tools like Virtual Private Networks (VPNs) or the Tor browser that can conceal a user's location and online activities.

 

This would also allow the NSA and FBI to deploy large botnets.  What could possibly go wrong?  As more of these draconian laws are enacted, the prospect of freedom and democracy seems to be a paper tiger.

That's right, the people charged with keeping you safe are also the people infecting your computer and turning it into a zombie.

 

I don't live in the US, but this has been too much. Go on the streets, sign letters, email your senators, do something if you care about your own security! The people charged with keeping you safe are able to do so no more.

To clarify, the reason why it is over reaching is because a person doesn't have to be identified for the warrant to be approved despite the fact that it is required for a copy of the warrant to be given to the person that is identified.

 

Under normal circumstances, law enforcement are required to identify a person that the warrant is to be issued to before it is approved.

Too many people don't know/care. I look at tech news for hours Monday-Friday and this is the first time I've even heard of this. 

 

I constantly try to spread awareness about these kinds of things on social media and in my community, but thinking of taking it further than that always reminds me of Aaron Swartz.
