What I don't understand while watching this... is that States are being declared before all of the votes are counted...

According to how the nation was run before bush was president, the president of the United States was controlled by checks and balances but since the Bush campaign's push for executive power the President has been able to circumvent Congress and do what they please, both Bush and Obama have done so and it's likely the next President could do the same.

That was always a President's power though, whether or not they use it correctly isn't the point, the Bush administration set new precedents into how Checks and Balances work by disregarding Congress where Congress should constitutional have a say.
