14 year old Irish girl is sueing Facebook because a naked picture of her was posted on the site?

Oh yeah, I certainly wasn't disagreeing with you. Her being a minor is a major reason why this has been reported so widely.

Technically it is Facebook's fault for posting it to the webs

 

But in reality its not there fault,Facebook is open so you can pretty post anything you want,and is HUGE so can they look at every photo posted every second? no...they did all they could in the shortest period of time possible....MAYBE now she will learn not to take pics at the age of 14 then send them to someone etc...and then BLAME facebook and say its facebook's mistake for them not being able to view her pic at the 1st second it was uploaded thru all the 1 gazillion photos remaining...

What she did obviously wasn't the correct thing to do and the pictures shouldn't have been taken , but I don't believe she should be listed as nobody gives a fuck about her as the person who posted the pictures is still in the wrong and she is going to get shit for it at school which is not correct either.

The conversation between you and I still links back to Facebook. Facebook should have banned the user and then alerted law enforcement because what this man is doing is illegal. Facebook is at fault, regardless, because they are likely hosting the pictures.

You won't hear me say this very often but I agree with Facebook, if they deleted it as soon as they were notified then they did everything they could. What else is there to do exactly? 

 

This raises a few interesting questions though. 

 

1) Why does a naked image of a 14yo girl even exist? No I'm not stupid and I was that age once but why are kids not being educated on this very topic by parents and schools? 

2) Are Facebook responsible for images posted on their site by other people? 

 

Thoughts? 

Yeah, as sad as it is, facebook isn't at fault. That is like being in a car crash and suing the government for owning the roads, it is highly frivolous.

Naked 14 year old sends ILLEGAL Child pornography to someone, then surprised that the probably 14 year old she sent it to redistributes it on the internet

So then she blames facebook.

 

2 illegal wrongs that facebook didn't commit and they are being blamed for it. The 14 year old and her ex are the ones who broke the law, facebook did all they can to stop it.

Hopefully it gets dismissed and her and her ex gets charged with making and distributing child pornography.

If Facebook knew that it was child pornagraphy they should report it. I mean if you see a crime you should report it regardless. I mean I think you're assuming that the girl knew right away that her picture had been posted and that may have not been the case. Either way Facebookso should have reported it because if everyone thinks it someone else's responsibility to report a crime then it will never get reported. But then again Facebook probably didn't have proof that it was child pornagraphy.

Who says they didn't? They have close ties with NCMEC but it didn't say that because this is NOT the issue here. If you've read the girl's complaint it specified that the problem was that facebook "haven't blocked the images after the first one" which is completely impossible for them without receiving a report. They already have an algo for stuff like that but it's not possible to block EVERY kind, what if they filtered the photo? changed a few pixels? edited the background? Heck, even youtube can't fully implement their algo of blocking copyrighted content because people just change the sounds or have the video occupy a portion of the video like one of those anime ones.

 

By going with their logic, any website that can host an image can basically be sued.

there is a lot of blaming on the wrong parties going on here im sure the girl did not mean for the picture to get on fb but she shouldn't be blaming fb for that and if she was blackmailed into sending a nude  (not familiar with laws in Ireland) wouldn't that her a victim of a sex crime and shouldn't the guy her blacked mailed her me charge for it

1. It will be interesting to see if Facebook gets into trouble for (technically and briefly) hosting child pornography.

 

I'm not the sort of person who victim blames in rape cases, but from the parents' perspective...

 

2. WHY DO THE NUDES EXIST IN THE FIRST PLACE?

I was a teenager once. I was 14 once. Yes, phones did have cameras. No, there wasn't a single moment when I thought "I want to send my nudes to someone", let alone actually acting on said thoughts.

 

3. I'm going to take a guess and say the next phone the parents give this girl, will be one without cameras, or with parental control software that disables camera apps or monitors all photos being taken.

 

4. If she can afford to sue, then I'm going to guess she is a rich spoilt child who gets a replacement for the $1000 iPhone she smashes every 3 months. Occasionally, one of them almost makes it to 4 months. Occasionally. Almost.

 

5. If the parents do not ground her until she is 30 and/or married, then I will be very VERY surprised.

If they're hosting the image, then they are as equally in possession of child pornography as the man who posted the images multiple times. And thus, it's Facebook's fault and a lawsuit is a reasonable action.

While that's technically correct I strongly doubt anybody would be able to make that stick, as long as Facebook have appropriate policies in place to deal with it when it happens and they can prove those policies were followed then it's really not on them. 

 

TBH I'd be very surprised if Facebook don't have agreements with police forces around the world whereby when this happens they hand over the images and the details of the poster to the police straightaway.

You just narrowed your age range to any potential paedophiles who may be stalking. Not your smartest move.
