California wants to ban encrypted smartphones

California assembly member Jim Cooper (D-9th) introduced the legislation, bill 1681, which requires any smartphone manufactured "on or after January 1, 2017, and sold in California after that date" to be "capable of being decrypted and unlocked by its manufacturer or its operating system provider."

 

Any smartphone that couldn't be decrypted on-demand would subject a seller to a $2,500 fine.

 

Well that was not expected by me (well rather it came earlier than I expected), sigh encryption from my point of view is a net good for the world yes some people will take advantage of it but anything can be used for harm since some people are both smart and sinister.

 

This news is also very similar to a proposal in NY which is currently in the NY senate.

 

Fortunately for Californians the bill is merely introduced not yet voted in so people could complain to their representatives if they oppose (HINT) and I hope people do so as this could be a rampant trend if not killed now.

I really hope this shit doesn't pass, especially in New York. Something like this sets a fairly dangerous precedent. One of the points to both of these bills is that the police or any other government organization could get info off of someone's phone without a warrant, not exactly due process if you ask me.

The UK is also getting on board with the idea, David Cameron the PM recently came out all guns blazing wanting to ban all end to end encryption. Guess we are all losing our privacy piece by piece.

Yeah, doesn't matter, it will pass. California legislature could pass anything they wanted with minimal impact on them. For instance, they passed a law sometime last year to put a surcharge on prepaid cell phones (for me it was 15% but apparently it's different depending on where you live) seemingly without anyone noticing or caring...I didn't know anything about it until I had to pay it. Typed it into google and not a single news article about it. I don't know why they do it or what the money goes to because there's just no information about it anywhere.

That is sad, really it is, if the people don't care about their rights or interests then who will, certainly not the government. In order to continue to live in a truly free society we must guard a rights with our very lives, as without those we are merely puppets whom don't even realize we have strings.

They're literally just banning personal digital safety and privacy.  If I want to encrypt my devices that's none of there business and actually recommended by security experts for the purposes of in case you lose it.  It should be illegal for governments to pass such stupid laws  :lol:

Technically its legal if it passes, even if the EFF thinks otherwise, but I do agree that the reason behind proposing the bill is a bit awkward. It'll probably get rejected or modified, and then come back around again.

 

It sounds like they're trying to fine tweak on a fourth amendment issue, not directly trying to infringe on people's privacy. In that if a warrant is served, they can look through your phone.

 

Note: The 4th Amendment goes both ways: In that it gives the government the right to look with an warrant while still protecting people's privacy from unreasonable search and seizures.

Out of curiosity, what's so upside down about So Cal?

I was born, raised, live, and work in So Cal and I've never really thought about anything feeling out of the norm.

 

I'll admit there are a few problem areas, mainly some parts of Fontana and San Bernardino, but other than that its a fairly 'normal' metropolitan (Riverside/Ontario) area with suburbs (Redlands/Yucaipa) and semi-rural areas (Cherry Valley, Moreno Valley, Banning).

Southern California in of itself is a really nice place to go. The wind turbine farms in Riverside County are fucking beautiful, Los Angeles County is a nice place to go visit, and the San Bernadino Mountains are really nice to visit.

 

California in itself? Yeah, it's really fucked up. Like, I don't know if Donald Trump or anyone in the Californian offices is more stupid.

Out of curiosity, what's so upside down about So Cal?

I was born, raised, live, and work in So Cal and I've never really thought about anything feeling out of the norm.

 

I'll admit there are a few problem areas, mainly some parts of Fontana and San Bernardino, but other than that its a fairly 'normal' metropolitan (Riverside/Ontario) area with suburbs (Redlands/Yucaipa) and semi-rural areas (Cherry Valley, Moreno Valley, Banning).

 

 

Southern California in of itself is a really nice place to go. The wind turbine farms in Riverside County are fucking beautiful, Los Angeles County is a nice place to go visit, and the San Bernadino Mountains are really nice to visit.

 

California in itself? Yeah, it's really fucked up. Like, I don't know if Donald Trump or anyone in the Californian offices is more stupid.

 

Yes I have been to So Cal and it is very nice to visit for the scenery and that is pretty much it.

California Politics makes it unbearable. Hollywood makes it unbearable. ( I have one more but it will start a flame war so I will not mention it)

Never cared about Hollywood. Going to the Paramount Pictures campus never interested me.

 

I've got family out there though. Pretty much everyone but my particular family lives in Southern California.
