That link goes through the entire process, and includes potential fees. The fee to file a claim is only between $30 and $70 - depending on how much you're claiming. You can also potentially get this fee waived, if you can reasonably prove that you can't afford it (Eg: You can show your bank statements showing how little you make, or make a spreadsheet showing your recurring bills vs your average income (include copies of each bill, your paystub, bank statements, etc). You can often also have the fee reimbursed as part of winning the claim.

 

Even if she has no job and no money, she must get money from somewhere to survive (relatives or social assistance, etc). If she does get a job, or if she gets social assistance, you could potentially have her wages garnished until she's able to pay back what she owes (assuming it rules in your favour).

 

Make sure to include the report you filed with the police, and a detailed description of events. You'd have a pretty decent shot at winning the case (though actually making her pay is a different story).

 

You don't need a lawyer for Small Claims court (In fact, you might not even be allowed to use one - not sure). So all you need is just to show up for the various court dates. If she doesn't show up in court to defend herself, you'll likely win by default.

Well, from my understanding in the eyes of at least the police, because she had her address in Flint and probably to that apartment, and eviction period in Michigan being 7 days. It might be thrown out of court whether she shows up or not. But you and @dalekphalm he might have a valid case to sue against. Though if she did any damage to the apartment, what @loganshaw9 could do is give his landlord a copy of the police report and the landlord could sue for damages to the property. (the unit itself not the contents) which OP didn't say if there was any damage to the unit excluding contents that he can prove he didn't do.

I don't think it would be thrown out of court automatically. You can sue your partner/girlfriend/wife/etc for lots of things.

Most places do have Common Law laws around marriage. Basically if you live with your partner for a specific amount of time (Typically between 1 and 3 years - but it varies by Country/Province/State), once that time has passed, you're considered "Common Law married". It doesn't have all the same protections and responsibilities of legal marriage, but it does include a lot of them.

 

So in such a case, if they lived together long enough, they might be considered Common Law married.

Anyway with that in mind, even if you're married to someone, they can't just destroy everything you own as a couple. You can still take them to court - you just might not get 100% reimbursed.

Ive been thought it once and I got everything replaced and she had to pay. 

Screwed up laws are still a thing though, in my state schools have the power to have children thrown in jail for missing school rather than giving a more appropriate punishment; for a state to make it legal to destroy anything within a house that you live in even if it's not yours doesn't surprise me in the least.

well most those laws are maximum phishnet and they will do other things before that. like if you miss over 2 weeks of school police can come you your house and escort you to class.

 

and they usally dont even go that far even if they can.
