Graphics card manufacturer Nvidia agreed to a preliminary settlement that will resolve claims in a group of proposed class action lawsuits that center around allegations that the company misled consumers about the performance and storage capabilities of its product.

Nvidia says it will pay each buyer of the graphics card $30 and will pay an additional $1.3 million in attorneys’ fees, according to settlement documents.

The overall settlement amount was not publicly disclosed within court papers, however Nvidia agreed to pay all consumers who purchased the GTX 970 graphics card and indicated there would not be a cap on the total amount it would pay consumers.

“The settlement is fair and reasonable and falls within the range of possible approval,” attorneys for the proposed Class said in the filing. “It is the product of extended arms-length negotiations between experienced attorneys familiar with the legal and factual issues of this case and all settlement class members are treated fairly under the terms of the settlement.”

 

a couple of individual suits were filled back in 2015 and were merger into a class action 

the problem was that nVidia falsely advertised GTX970 having 4GB of VRAM without disclosing the fact those 4GB were actually split in two partitions, a 3.5GB and .5GB

the 2nd one was modifying the drivers to show the GPU as having 64 ROPs, when in reality it only had 56

Well let's say 1 million are affected that means 30 million dollars goes to the plaintiffs overall

Well yeah, though they don't make close to 100% profit, so they probably get about 35-60% of the income on 970 sales, though they sold far more than a million of those damn things

Yay, I get $30. AMD has to be so pissed though. I know I would have bought an R9 290x had the gimped VRAM been public knowledge when I bought my GTX 970.

Not sure why youre saying that it doesnt solve anything? Considering all you could really get them on was misrepresenting the memory bandwidth on the box and the difference in the ROPS there wasnt much there to go on.


But they settled the case, paid attorney fees, and people who already got a crazy good performing card for the price, got it even cheaper. For the tons and tons and tons of people who own this card this should be a good thing yes?

 

About the only thing you couldve gotten more was admitting wrongdoing legally, which there is no way in hell they would do. So you should be happy that you proved a point, and hope that they learn from it again. If they dont you start the whole process over again.
