Well what Pewdiepie should do is just stop doing videos about Nintendo games, build a media-pack with the data about his channel (demographics, daily views, unique users, etc), and send it do Nintendo with pricing. "If you want me to play your games, this is the fee to reach this people. If not, it's all good - but if I'm asked why I don't do it, I'll just have to say that Nintendo doesn't allow me to play their games."
