There are exeptions, though. If a bar only have a consumer-grade radio, for example, they don't can't have to pay for a performance license, as per the American Copyrights Act. 

The problem only arise when the establishment has a professional (or at least non-consumer) sound system. 

 

There are also issues pertaining to the size of the establishment and whether or not the broadcasted source is FFC licensed, but the main issue is the equipment the broadcast is played from. 

I'm talking about cases where they would actually go in and try to extort money from the owner/proprietor for playing consumer grade radio.

 

Either way, record labels need to die. The fees they collect for "illegally" played music are insane. A quick google search shows a somewhat recent instance where a bar/restaurant is being ordered to pay $30k for "illegally" playing four songs, and $10k in legal fees.

 

That's insane.

The Spotify manager said artists receive 50% of the revenue. I assume it his higher than previous deals with labels since Spotify makes its money with subscriptions and they lost over a billion dollar in the last two years alone.

That's insane.

It's kinda unfair to just blame the labels. They're just following the law. If the labels were out of the picture, then the artist could just make the same claim. You're just removing a middleman.

It's honestly copyright law that needs a serious overhaul.

 

In the case where an establishment plays from a consumer radio there are a couple of things that the rights holders can argue.

  1. If the performance is done via prerecorded media (CDs, records, tapes, downloads etc.), then the performance is illegal no matter the equipment it is played through. Basically, you can legally play a Spotify stream as a performace, but it's illegal to play a track you've downloaded for offline play in Spotify without paying for a broadcasting and a performance license.
  2. The line between consumer equipment and professional equipment is, unfortunately, not really clear, so it could be argued that any equipment used in a professional environment is non-consumer by definition. This is also why rightsholders from various industries have argued for revising the American Copyrights Act, since consumer equipment is much different today than it was in the 1990's.

I would also love for a case of public performance from a consumer radio to go to court.

While it is interesting to see how "consumer grade" is to be interpreted in 2018, I would also love to see the labels charced with illegal extortion.

like when they send a lawyer into a bar or restaurant that happens to play the radio, claiming that the owner/proprietor has to pay licensing for the songs on the radio, which is entirely legally incorrect because the radio station already paid for that license to play the music publicly over the airwaves.

For the resources like recording studios, connections with big artists, and promotion.

I'm just hoping this doesn't open the floodgates to my discover weekly and release radar getting inundated with high school rock bands and shitty rap artists who make all their beats in GarageBand. Thats what soundcloud and bandcamp are for. I'm all for giving artists more money, they already get screwed by scalpers reselling all their shows tickets for 2x-5x face value which they see none of.

 

Also wondering if artists can actually pull away from their labels to get more money on Spotify, or if it is in their contracts that they cannot and must go through them... very interesting to see how this gets used.

It's honestly copyright law that needs a serious overhaul.

 

In the case where an establishment plays from a consumer radio there are a couple of things that the rights holders can argue.

  1. If the performance is done via prerecorded media (CDs, records, tapes, downloads etc.), then the performance is illegal no matter the equipment it is played through. Basically, you can legally play a Spotify stream as a performace, but it's illegal to play a track you've downloaded for offline play in Spotify without paying for a broadcasting and a performance license.
  2. The line between consumer equipment and professional equipment is, unfortunately, not really clear, so it could be argued that any equipment used in a professional environment is non-consumer by definition. This is also why rightsholders from various industries have argued for revising the American Copyrights Act, since consumer equipment is much different today than it was in the 1990's.

I would also love for a case of public performance from a consumer radio to go to court.

While it is interesting to see how "consumer grade" is to be interpreted in 2018, I would also love to see the labels charced with illegal extortion.

These are cases where a restaurant/bar literally just had the radio on during business hours. The rely on the owner not knowing that it's perfectly legal to play the radio in a business because the radio station already pay for a license to broadcast that song to anyone with a radio within listening distance. I only know about it thanks to a few episodes of The Tek back when Tek Syndicate still had Wendell (pre-tekxit as we call it)

 

I agree completely that the copyright system needs a complete and total overhaul by people who are not in their 50's and lawyers.

I agree, but I can see the argument from the other side. "Not everyone can do what Stardew Valley or blank popular indie game did".

 

My response would be, true. But that doesn't mean we need to keep the same idiotic corporate structure. My main issue with most corporate structures is that those who don't do any actual work to make the company money, those who merely organize the company or support it, seem to pay themselves the most because they can.

 

That's something that needs to change in large corporations regardless of the industry. If we're suppose to be a meritocracy as a society, which we are to some extent, then people who merely organize a company don't deserve to be the best paid by and large. They definitely shouldn't be the only ones to get their pension or whatever when they organize the company into bankruptcy.

Also, for some more percentages. Out of the 70% that right holders got in the past, only 10% or less were given to the artist. More often than not the actual % was closer to 5% or worse depending on contract.

Those numbers are only really accurate if you're signed with a major label. There are quite a few "label services" out there now that help with getting your content on Spotify, Google Play Music, Apple Music, Groove, etc.

 

One such service that a friend of mine uses is DistroKid which is a flat fee label service that doesn't claim your copyright, merely requires you lisence to them for redistribution. They take no cut other than a flat yearly fee.

 

Sure with this you can save the $20 a year or whatever it is if you do it through Spotify yourself, but you have to go through the hassle of manually managing the upload not just to Spotify, but to any other services you want to upload to. The "label services" handle it for you, so you upload once to them, fill in track and album info, and they publish it for you to all the various platforms.
