OEM 6800k from ebay not new? Ripoff?

So thats it the seller has did, i failt.

1 week ago i bought a 6800K on Ebay, marked as OEM and new.
So today i got it but it was clearly used and it has thermal paste marks.
Is this from factory testing or somthing or did the seller lie to me?

Do you have the link to the original auction? What did the original auction pictures look like? Clearly, that is a used CPU, and if the auction specifically said new and unused, you have the right to go after the seller for either partial refund to bring the value of the CPU in line with a used one (whatever that may be) or a full refund because the item is not as described.

 

Whatever you do, don't install it into your PC until the matter is resolved.

When dealing with eBay sellers, I always message the seller first with a polite and professional message.  If they can't (or won't) resolve the issue to my satisfaction, I contact eBay and go throught there procedure.  eBay has always found a resolution for me, whether its a partial or full refund.

The post clearly stated new and never opened.  sounds shady as fuck.  Definitely open a ticket with ebay.

I'd ask for a full refund with the seller providing a prepaid shipping label for the return. It sounds harsh and it is, but if you install that CPU in your computer and it's dead in a month, guess who's screwed out of $400? The seller clearly stated new, the CPU is obviously not new, get your money back and try again.

I forgot to mention that they didn't even ask for the item back when i got the refund.  I'm not sure if that was intended or an error of some sort, but you may end up with a free processor depending on the outcome

The seller replied with:

"After checking the photos again , the CPU serial number doesn't match . The CPU on photos is not our product. We cannot accept the return. "

My only chance is ebay now, lets hope they work with me!

Unpopular Opinion here:

Does it work? If it does, keep it. For me it wouldn't be a big deal, so I would go for a partial refund. Knowing that ebay sides with the buyer in most cases, your chances of getting a pretty good deal that way are pretty high.

There is no CPU serial in my invoice.

Wow, what a scumbag.  did you contact ebay before he reported you?  do you have an invoice that came with the package?  Check your ebay profile under "purchases" and it should have an order number or item number.  see if they match.  Point being is there should be a way to match what you bought to what was actually shipped.  If they don't match, then they sent you the wrong product anyways so they're still in the wrong

Yes. In most cases, they will side with the buyer.

But you have to make it easy for them:

1. If the seller states something like this, demand proof. If they deliver wrong information, point that out. Keep all your messages as short and as clear as possible. Always be polite and constructive.

2. Only accept messages via ebay. No email or other communication

 

If your case can't be resolved by the seller, ebay may look over all your messages. So you can improve your chances to almost 100%, if you help the ebay employee to find out what really happened quickly.

its the number starting 252....that should be your item number.  Furthermore, how does he know the serial numbers don't match?
