Newegg in court over patent dispute

Newegg is on trial over patent dispute. The company taking Newegg is TQP Development (no websites) The reason for this, is because Newegg is using an encryption system for it's accounts, which TQP Development believes that they own the patent too. TQP Development is refereed as a patent troll company by media and people.

 

This is not the first time TQP Development is taking Newegg to court over patent dispute.

Newegg won every other cases, also by other similar companies. Last one was in September of this year with again TQP.

 

 

Would anyone be uncomfortable handing $5 million to someone over a patent?

That's one of the questions that a lawyer for a mysterious company called TQP Development put to a panel of potential jurors here yesterday. In the process of choosing a jury to preside in TQP's showdown with online retailer Newegg, more information about TQP has become public. The company became controversial last year when it earned publicity for suing hundreds of companies over commonly used Web encryption technology. It's also owned by prolific patent licensor Erich Spangenberg, a man who Newegg's top lawyer, Lee Cheng, has referred to as a "patent troll."

 

The demand is actually low by the standards of patent cases that go to trial. It can cost $5 million just to try a patent case, and it's extremely difficult to do so for less than $2 million. It's very likely that Newegg could have escaped the case for under $500,000 at some point.

But the TQP patent campaign has always been about breadth. It has collected around $40 million from the companies it has sued, according to Spangenberg. With more than 20 companies still in the litigation pipeline, TQP's push against Newegg actually has more to do with protecting its ability to collect on those cases—and Newegg's refusal to back down.

I really did wish that these companies would be shut down entirely and those responsible are put in prison for 10 years. That included the CEO of Apple and any other company CEO responsible for patent trolling. I think you would find it would put a complete stop to all stupid patent crap for good.

Couldn't agree more.  Someone high up and well known at Apple has to be jailed or slapped with some punishment for their ridiculous patent lawsuits.

It's their company so they should be responsible for everything that happens. If they don't know everything that is going on then they are not organised enough or they are just too big. If I went and patented something stupid and then patent trolled everyone I don't think the government wouldn't hesitate to throw me in jail or prevent me from doing so but when its a company that makes a shit ton of money the government protects the hell out of them.

Their inhouse Lawyer even announced they would fight every patenttroll who wants to take them on. He seemed to be pretty confident in winning. I think they will be fine.

you realize apple has 15500 patents 8.5 percent of which are in america. when its the foundation of why your company exists you are going to fight tooth and nail to keep whats truly yours. lets say you have a special recipe for make a pie. and every one in your town comes to eat your delicious pies. then a store opens up across town advertising the exact same pie. now you draw in only half the crowd. are you going to fight to shut this new company down for stealing your recipe?

Then you need to make eating your pie better. Maybe have a TV in the store or be friendlier to the customers. That is how capitalism should be. If there are patents then no one improves on anything and everything stays crappy. If we didn't have patents then everyone would be trying to improve everything all the time. If Apple didn't hold so many patents on stupid things then it would have had much more competition from smaller companies and would have changed their products much more then it has.

yeah 15499 of those patents are for shapes, colours, screens that produce images, phones with speakers, a small black or white rectangle with rounded corners and my favourite: a patent on the theft. Only apple have the right to steal ideas and technology.

I don't want there to be a patent system, I want companies to survive by producing good products at reasonable prices, if they can't survive by making decent products then they don't deserve to survive.  And they certainly don't deserve to make other people pay for their inability to be competitive or produce what the consumer wants.

I think it would be great if the one that lost a court case was punished somehow. So that for example if for example Apple sued company X and lost, Apple would have to pay company X to cover their expenses and worsened reputation. That would probably make companies more careful before patent trolling.

Hey, hey hey... Are you implying Apple did not invent (remember: the requirement for a patent is that there is no prior art) the black rectangle with curved edges? The patent office would like a word with you sir... And how dare you suggest that colorful, square icons in a grid was even thought of before 2007?

Apple should obviously have those patents because they did it first. Without Apple, we wouldn't have any black rectangles.
