Apple strikes yet again!!!

A big topic in the UK recently has been how those with disabilities (such as those needing to lip-read or mental disorders) are exempt from wearing face masks.  Since many of these conditions are invisible to everyone else, this has led to multiple incidents where they are very publicly abused verbally for this exemption.  During the extended video of this report today from the BBC, another incident caught my eye.

 

A family covered in the report has a 10-year old child with Sensory Processing Disorder, which means if they have anything hooked over their ears or face, they become exremely distressed.  Per the Covid guidelines, all children under 11 are exempt from wearing face masks.  As you can imagine, however, members of Apple have been challenging this - they banned the child from entering a store because he wasn't wearing a face mask...

 

Whilst Apple's policy makers have stated they are complying with the UK Government's Covid guidelines, reports by other news outlets state all Apple Stores are still being told to employ a "no mask, no entry" rule.  Why can't Apple ever just do what they're told?!

It's a private store they can not allow you to enter if you are 6 feet tall or have brown hair it doesn't matter the reason. This is just clickbait because Apple and Corona and a child with a disability. It's actually sad news has come to this. No shirt no shoes no service has been a policy for decades now and it's the same thing as a mask. Apple has all the rights to not allow them and frankly you can just wait to go to the Apple store until things get better. Purchase it online and if you need repairs Apple will send you a box to ship in your product for them to fix.

I'm not trying to create clickbait.  There are other businesses who've been ignoring the government rules, but it almost seems as though Apple wants to stay in the news, even if that news embarasses them.

I don't believe you are correct. What follows is my interperetation. I am not a lawyer and nothing in this post is to be treated as legal advice.

 

In the UK, disability is what is known as a "protected characteristic" which makes it illegal to discriminate against under the Equality Act 2010, which says:

        (b)A cannot show that the treatment is a proportionate means of achieving a legitimate aim.

Not wearing a mask arises in consequence of the child's disability.

I don't think the "legitimate aim" applies here because the government guidance is very clear that those with a disability affecting their ability to wear a mask do not have to do so.

We can assume that the store employees knew about the child's disability as the child or their parents would presumably have told them on being denied entry.

 

Therefore, the Apple store employees and/or Apple themselves for setting the policy have acted unlawfully.

By the way, my desktop is a docked laptop. Get over it, No seriously, I have an exterrnal monitor, keyboard, mouse, headset, ethernet and cooling fans all connected. Using it feels no different to a desktop, it works for several hours if the power goes out, and disconnecting just a few cables gives me something I can take on the go. There's enough power for all games I play and it even copes with basic (and some not-so-basic) video editing. Give it a go - you might just love it.

It's not the fact if they have a disability or not it's Apple's policy that you need a mask to enter the store. If you don't have a mask you cannot enter no matter what the circumstance is. It wasn't Apple saying you cannot enter because you have a disability it's just in this scenario the child doesn't legally need one like others might because of their disability. But that still doesn't stop Apple from denying entry to protect their own workers. I get what you are saying but they can't make exceptions to their rules

This is incorrect. The face mask rules in the UK are not blanket. Disabled people are specifically allowed not to wear a face mask in the UK.

By the way, my desktop is a docked laptop. Get over it, No seriously, I have an exterrnal monitor, keyboard, mouse, headset, ethernet and cooling fans all connected. Using it feels no different to a desktop, it works for several hours if the power goes out, and disconnecting just a few cables gives me something I can take on the go. There's enough power for all games I play and it even copes with basic (and some not-so-basic) video editing. Give it a go - you might just love it.

Besides his disabilities, the child is also under the age of 11, where the government has explicitly stated all under this age are not required to wear a face mask in shops.  This is as much a case of Apple not interested in obeying the rules they've been given, as it is discrimination.

You're looking at it from the wrong way. The "single" group is people not wearing masks for whatever reason. This could be a giant list as to why, ranging from things like disabilities or religious affiliation, but Apple states you need a mask to enter their store and that's that. It just so happens in this case the boy's reason was he was disabled. That's not why they didn't let him in the store though.

also i dont understand how not wearing a mask helps you lipread dont you need other people to not wear a mask? and sorry im not taking off my mask for those people i can get a piece of paper and a pen and we can write to each other

You seem to be fundementally misunderstanding the premise of this.

 

Let's say I've planned a trip somewhere. If I eat some rotten food and become sick, and that means I can't go on the trip, then I can say that I can't go on the trip because I ate the rotten food.

 

Similarly, if someone has a disability, they are unable to wear a face mask, and someone stops them from going into a shop, then the reason they can't go into the shop is because of their disability. Which is illegal.

 

As far as I'm aware In UK law (and I'm not a lawyer, this is not legal advice), protected characteristics are untouchable (which is a good thing). Pretty much any policy which negatively impacts people with them is unlawful.

By the way, my desktop is a docked laptop. Get over it, No seriously, I have an exterrnal monitor, keyboard, mouse, headset, ethernet and cooling fans all connected. Using it feels no different to a desktop, it works for several hours if the power goes out, and disconnecting just a few cables gives me something I can take on the go. There's enough power for all games I play and it even copes with basic (and some not-so-basic) video editing. Give it a go - you might just love it.
