trading was implemented for people who have an item that dont want it, and people who dont have an item and want it.

 

those websites *do* operate trough "trading", but they operate trough trading in the same way as alcoholism uses a bottle. you cannot change the bottle to stop alcoholism.

Well people gave the "bottle" stupidly high value. Community is to blame.

also.. those 3rd party sites kinda arent gambling, they're pretty much an outright scam hidden as a gambling website. (who knew, gambling websites are scams, amirite?)

every time you go and gamble  or get scammed they just made more money because you go back and buy more keys. Look at how steam is made , they give you levels / cards for making purchases on their platform  (also achievements), very effective techniques to keep a addict on their platform ; it's very naive to think that a company is not all about the money and exploiting their consumers. (especially one that bases their games on gambling/ dopamine )

or you are like the far majority of steam users that have a hard time even remembering their own steam level, let alone caring about it.

 

both the steam level and the cards are a fun quirk, but i'll never understand the reason why people care to the point they pump money into it, just like i'll never understand why people used to feel the need to collect every yugioh card back in the day...

There's a big difference between a stupid unenforceable state law and federal laws regarding fraud and potentially gambling.

Yup. They still make money from trade fees, and kiddos still can spend thousands on keys. Win win but puts all CSGO gambling sites out of business which is good.

They threw me some Heineken beer and I've been sitting staring at the people of this forum and earth since.

thats nothing to do with the law, thats the humans enforcing it. they pick the sentence.

But humans also made the laws. At the end it mostly comes down to morals regardless of the legality. Taking advantage of their young ass subs and getting them into gambling is not cool at all. It can be a very addictive activity regardless of what type of gambling it is whether its gaming skins or chips at a casino.

the laws are made simple. you do this and this happens, then people think they need to put feelings and shit into it, no, you just need proof they did the crime and give them all the same punishment, but too many variables for that right? and variables that dont matter like race and background. 

 

but again you gotta look at stuff from both sides, what they did was smart.

Not sure what's smart about getting caught red handed, being reported and investigated by the FCC and getting a tonne of negative press is 'smart'.  Getting AWAY with a crime can be smart, getting CAUGHT is a result of being pretty stupid.

Umm No. Laws are legal codes which are meant to be enforced. 

 

First yes there are laws on the books which are no longer enforced. These are laws which made sense at any given time but no longer do so today due to changes in morals or obsolesce. These are dead laws and are no longer considered legally binding. The only reason they haven't been repealed is the complexity and cost of repealing old laws. There are only so many days in a legislative calendar, might as well save those for laws which actually in force. Therefore, the executive has decided not to enforce these laws because they are no longer necessary or deemed acceptable. The judiciary would also never uphold one of these laws. Strictly speaking these are no longer laws. 

 

Second, the mere act of acting contrary to the law (actus rea) is not necessarily sufficient to have someone found guilty. A person mental state (mens rea) is also take into consideration. If a person did not have the intent to commit the crime then generally that personal would not be found culpable for the crime.

 

In determining a persons culpability, extenuating circumstances are often taken into account in doling out sentences. Mitigating and aggravating factors are always taken into account and may result in a varied sentence. These factors can include such things as the severity of the crime, whether any actual harm was done, your legal history. who was harmed, whether or not there was any monetary gain etc. Depending on the aggravating and mitigating factors you could potentially see yourself getting charges dropped to facing a large fine and in certain exceptional cases, jail time. 

 

The only exception is strict liability. With strict liability, the Mens Rea element does not mater. Which goes to my third point, not all laws are equal. The violation of certain laws is considered far more severe than the violation of other laws. Someone who commits murder is generally considered more culpable then someone who shoplifts at the local Walmart. Then there are higher laws and lower laws as well, laws which violate higher laws (such as the constitution) cannot be enforced unless changes are made to the higher law.

 

All in all, the law is far more complicated than what you suggest. A law isn't merely a law. 

 

In this case, though, they could be looking at some pretty severe fines from the FCC for undisclosed advertising and promoting your own business. These will be compounded by the aggravating factors: not only where they promoting their own business without disclosure, they were promoting their own gambling website, they were targeting minors, and then attempted to cover it up. Depending on the state law in California they could be facing additional penalties from the State Government. The State Prosecutor will also take into consideration all the aggravating factors as well.
