Lawsuit claims Apple deliberately misled customers regarding the notch

Apple is describing the resolution length and width, not the total pixel count.  You might not be getting every last pixel possible in that space, but it's still making use of that length and width.

Are they? Previously to the notch, all screens *were* 1080p tall by 1920 high (as an example). Now, does that mean I can cut out 99% of the pixels, and leave ONLY the corners and it still be a trueful statement?

At which point does it stop being true, and become a lie? Or at which point does it stop being misleading and become "normal"? A Notch was new, but Apple used the old counting/naming scheme.

You need to back up your statement if you think they are advertising the resolution width and height accurately. 1080p/1440p has specific industry standards: https://en.wikipedia.org/wiki/1080p

I would post something from the Apple website, but after 15 seconds of attempting to look at it, I would rather turn my eyes into porcupines than try and navigate that car crash of a "website".

[edit]

Ok, I did find it, and so far no injuries...

iPhone XS Max

6.5”

Super Retina custom OLED display1

2688×1242 resolution

458 pixels per inch

If it is not 458 pixels per inch, it's not. :P It's "up to"... If it is not 2688x1242 is it not (though it may be?)

The iPhone XS display has rounded corners that follow a beautiful curved design, and these corners are within a standard rectangle. When measured as a standard rectangular shape, the screen is 5.85 inches diagonally (actual viewable area is less).

Oh snap... so Apple do know they are marketing it with an "asterix" to the details. That is fine. If this court case is from *before* Apple put up that notice/information, then I'm all for customers being reasonably unhappy. Though a £20 cheque in the post for the lost pixels probably is not worth the time... it is though worth the effort to make sure companies are honest in their marketing!

It wasn't. That information has been there since before the X was available to own.

I remember spotting that. Very sneaky and lots of stupid, loyal customers who don't look into phones won't catch this. Their fault for not researching, though.

Oh, one thing I think people have missed is that at Apple, they have a 14 day no questions asked return policy....so if this lady was actually upset about the notch, she could have gotten her money back. But nah, her and her lawyer are probably just looking to make a quick buck. It’s sad really.

The case is probably resting upon the assumption that Apple would just rather settle so she can go away....I’d personally love it if Apple didn’t settle and sued her back for damage to their public image ?

How to make sure no one ever building a rounded corner screen ever again. No one is ever going to market the 50+ different width's on the top and bottom of the display.

I mean, the article said,

...leading Davis to believe that the iPhone XS Max she preordered wouldn’t actually come with a notch

so that's still a valid complaint even with the 14-day return policy.

Yeah, people shouldn't sue companies for a quick buck but at the same time  I don't feel sorry for the $1 trillion dollar company but that's just me.

I hate to say it, but....

...shouldn't she be looking at other photos of the phone before making her decision? I can definitely tell you that I would make sure that the phone fits my specific requirements before plopping down the money for one, especially when that phone costs a metric whackton

She could look all she wants, but at the end of the day, we know that Apple forced her to buy one a dozen.
