Milk doesn't get dispensed out of the machine. Given the size and angle of the "spout" it's the handle of the portafilter which is where the grounds go in and coffee is poured out the bottom (which is why there is a grate there).

 

They maybe could have argued that it's the milk streamer/frother, but that's still not how you use it anyway.

 

I don't drink coffee but i was technically a certified barista for a few years
