A second YouTube'r has now fallen victim to DMCA abuse from 'that game dev'.

Sorry if this has been posted already, happened 22 Oct. 2013. 

 

 

 

 

 

How/why has this happened again. It's ridiculous? Ok, they couldn't have done anything in the short time in which the first take down was issued, but still. The amount of attention total biscuits video has gotten in such a short time must have brought something!?

 

This really should bring about new methodology for this. May take a while, but it needs to change. This is a prime example for why this system is fundamentally flawed.

why doesnt TB do the same negative review but dont monetize it.  make it 100% free what will their excuse be then

There is no evidence this is the same company, people are making the connection without facts. Innocent until proven guilty, remember that.

 

Now, whomever is doing this, needs to be held civilly liable. I doubt you could make a criminal case, but lost revenue well, that is a different story.

You could easily claim that they were obstructing your business, take them to court and win. Let's face it, it's the business's duty to act in a social and ethical manner and whilst following laws, go above and beyond that (if you don't... you're saying good bye to good PR) and some have simply failed to do so.

He did not get a DMCA takedown,  he got flagged for "spam, scam and commercially deceptive content".. which is even worse since anybody can do it.  

 

So IF it was "that game dev" then he  can't do a DMCA takedown on a pokemon game video, and taking down his own game's review would be too obvious...  next best thing... fake accounts to flag videos.

Yeh, saw that after watching the video.

 

Just the way total and Dan put it sounded like the same scenario.

 

Although it still does lead to the point; the system is flawed and more needs to be done to protect the content creators.

 

It's far too easy to get a video removed. From flagging to DCMA, whatever it is, automated systems, no matter how ingenious Google intends them to be, cannot cut it. There needs to be formal independent human review and a proper complaints/take down system in which people can be held responsible for false claims. YouTube isn't just a 'thing' anymore, its one of the most popular websites in the world with multi-billion dollar funds at its disposal.
