French magazine fined €10,000 for writing about piracy

Consequences if what you do is illegal. Do you think listing a bunch of websites is illegal!?

Promoting piracy is illegal in France, so yes, listing websites can be illegal.

if you have to insist you think for yourself, i'm not going to believe you.

From a legal standpoint, displaying information is not necessarily encouraging the use of it. News networks influence people because they include opinions and arguments. That's not just "displaying information"

Encourage also means to help something to occur. Could also mean to give support to get people to do something or to continue to do something. By posting pirating links or by posting how to find pirated software, you're helping pirating occur regardless of whether viewers follow that encouragement. From the article, it seems like they explained how to find pirated software, which is giving advice to people on how to pirate (which coincides with the definition of encouraging). The part where they explain torrent clients is fine though.

 

Also opinions and arguments are just more information that is being displayed. The information being displayed doesn't have to be the raw, objective information. Information includes all biases and subjective views. Posting a guide to getting pirated software is information and as explained above is encouraging piracy.

Inside, it gave an overview of torrent clients such as iTorrent and BitComent, and also explained to readers that you can often find pirated downloads through Google Search.

In France, it is forbidden to "knowingly encourage" the use of software primarily used to share copyrighted content. This is the first time a news outlet has been found guilty of encouraging piracy under this section of French law, the TorrentFreak report added.

Again, listing a bunch of sites is not promoting piracy in any way. It is like saying that if they cover a topic about terrorism, they are promoting it as well. There is no reasoning behind this fine and it is definitely against the freedom of speech. And no it is not freedom if you have to pay in order to voice your opinion.

I did read the article. They only said where they can get the software. They are not promoting it. What I said in my post still stands. But hell, even if they did actively promote the websites, the websites themselves are not illegal; it is up to the user to decide what to download.

Encouraging and promoting are different things. Also, Your example isn't great because you missed the point which I will quote below:

If you post a link explaining how to get pirated downloads, then you are encouraging it. If the whole point was to get people to understand torrent clients, then you can basically make a guide of downloading some free music someone put up as a torrent (because people do that). If you're guide is about downloading pirated software, then you are encouraging it. In other words, if I showed you how to fish, you would feel some encouragement to fish. Whether you take that encouragement or not is up to you, but encouragement has nothing to do with people doing the action, but more giving advice to people to do that action. In your example, the scenario would be if some news site linked to a recruitment site for terrorism, would that be encouraging it? I'm pretty sure that is encouraging that kind of behaviour...

If there was news about a terrorist attack and they say they used an AK-47 and the suspected dealer seems to be China and they obtained their weapons through drone deliveries (lol whatever), are they promoting China as a weapon supplier?

They're stimulating the view that China is a weapon supplier which fits the definition of encourage.

That depends a lot upon the language used in the article. If they merely explained where to get freeware (copyleft software, which is not piracy because its meant to be distributed freely), then they haven't encouraged anyone to pirate. Torrents in and of themselves are not illegal, what you do with them can be.

 

If they said "get that software you can't afford here for free" that would be encouraging piracy. If they said "you can get freeware here" that would not be encouraging piracy. You can't assume piracy at the mere mention of torrents, as that would be an assumption of guilt (not a valid assumption in the US at least. Not sure if France does the whole "innocent until proven guilty" thing like we do).

 

Although, after re-reading the original post, I see that they specifically explained where to find pirated software, so yeah, they broke the law. Not sure what they were thinking. Although the argument still seems silly to me, as it's easy enough to find your way into piracy, just by way of having an internet connection.

Not very hard to find the best places tbh. Just google it. Anyone with half a brain which wants free content will not find it hard. As for moral side or "should do I this or not side ?" well that depends on the person.

 

Side Note.

 

As long as there is the internet there will be piracy. 

God I can remember before the internet when I was a kid I used to goto sunday car boots and there where people on stalls selling all sorting of stuff which was copied.

The internet has just made it more accessible for the masses. Its also made it harder for the goverments/companies to stop it. And tbh it will not stop no matter how hard they try.

And you don't need a magazine to tell you how to contact the guys with the eye patch, Google and youtube are your friends xD.

 

No freedom of speech was violated, they could have at least told people how torrents work, not where to get free stuffz.

They can have a shovel, that was a dumb move.
