But its a joke. Theres no implied expectation that when someones telling a joke that they are being honest. In fact the opposite is implied.

And nothing is off the table when it comes to comedy. Either its all fair game or none of it is.

Thats not to say that you can hate certain jokes. But you should still acknowledge them as a joke

If you have to say its a joke, its not a joke. He's still making a statement in a public space.

Yes its still a joke.

You dont even have to say its a joke for it to be a joke. Its asinine to assume that anything said in a comedy act is not a joke.

Now you can say its a bad joke. But its still a joke.

I have not read the court papers. Have you? Did he defame him and cause harm at his place of work/work applications?

You think the court case was "he upset my feelings"? Not "he accused me of money fraud, now I cannot get a rental car/flat deposit insurance".

The comedian was charged with infringing his right to freedom of expression. Read the article. There was never any defamation claim in the article or court case.

2 hours ago, TechyBen said:

Yes. So, in this court case. Did they go over, if this joke had a threat to the victim. That, as he was disabled, and had (possibly) social requirements (payments from social funds/job security/living expenses from charity). that this joke did or did not stop him getting those? I guess it would be better to rule "due to physical harm", but if the law only allows for this type of ruling, then that's what it allows for. We can argue deformation/slander, or what color of blue is "real". But America has those laws (as others have tried to establish) and Quebec has gone for these ones.

Quote

Ward was ordered to pay $35,000 to Jeremy Gabriel, who suffers from a genetic disorder that causes facial deformity and affects his hearing, due to a joke the comedian told at shows between 2010 and 2013

...

Ward added that he tried to drown Gabriel, but he wouldn’t die.

The Quebec Human Rights Tribunal ruled that the joke discriminated against Gabriel and his parents, ordering Ward to pay damages for “making discriminatory comments regarding Jéremy Gabriel, infringing his right to equality.

He publicly, joked about the persons disability, repeatedly. I wonder if they could just do a like for like ruling, and put the comedian on British TV Gameshows (but 2 wrongs don't make a right).

I really really don't bother to discuss many of these things with people. As the main error, is, they forget, life and society, people and reality, goes both ways. Just wait if some big popular/power wielding person (boss/teacher/counselor/comedian) spreads some "joke" about you having it off with someone and/or stealing from the stock cupboard, and how your bonus talks go with your next performance meeting at work etc.

Society has realities. I wonder if the comedian realised them too?

There was never a defamation claim, nor charges of damages to be reimbursed, just an infringement of his right to freedom of expression. Which makes no sense. No one ever claimed he had lost privileges or had any amount of financial harm done. I have no idea what point you think you're trying to make with the rest of that argument.

In defamation cases if you're suing for financial compensation there's some form of record required to ensure that the victim isn't put out, and that includes losing your job. None of that happened in this instance and no financial compensation is necessary.

Your argument about bosses is stupid. You're not entitled to a bonus or a raise, even if it was held back over a tasteless joke. Maybe your boss just finds your shampoo offensive and so he doesn't give you a raise. You didn't "lose" anything financially because you didn't have it to begin with.

I did enjoy the video, not sure what your point with it was. My favorite line was "We're making fun of you and you're smiling, you're already a very bad Preston."

Personally, I hope that more countries follow the US's example. (doesn't seem so likely unfortunately)

Sadly your right in thinking it probably wont happen.

The world has went from trying to fight through adversity and becoming a strong willed individual to catering to snowflakes.

Never in my life have i ever let words put me down. If i came home crying that someone called me a name my father wouldve looked at me and said "go to your room until your done crying pussy" lol.

Words cannot hurt you unless you let them. And i refuse to let anyone have that control over me to a huge extent. Im not immune to it. But im immune to it creating enough damage to hurt my day to day life.

I have two daughter age 8 and 14. And i cannot express how much fear i have over what the world will be like for them when they get my age. Im just hoping i can do enough to counter act society to not let them fall into the victim trap.

I recall the 'insecure 90's' and we thought that was bad. It paled in comparison to today...I can't imagine what the world will be like 20 years from now...

We're teaching people to be more tolerant of those over things they have no control over like sexuality, gender identity and visible disorders rather than reducing these things down to just "a joke", how terrible.

D'ya know how dehumanizing that is, to be ridiculed over something you have no control over?

Assuming the time stamp thing works, start at 5:04

But this is getting off topic.

Your point?

Most people wouldn't think showing kids grown adults wearing assless chaps is normal or acceptable.

Frankly I'm not sure what your original point was.

My point is that reducing someone down to a "joke" is dehumanizing and absolutely won't be tolerated by the one on the receiving end of the "joke". It's not that hard to understand.

It's usually something about how the LGB/T community is oppressed in places like the US and Canada.

Come Bloody Angel

Break off your chains

And look what I've found in the dirt.

Pale battered body

Seems she was struggling

Something is wrong with this world.

Fierce Bloody Angel

The blood is on your hands

Why did you come to this world?

Everybody turns to dust.

Everybody turns to dust.

The blood is on your hands.

The blood is on your hands!

Pyo.

You can be tolerant and still make jokes.

I treat everyone equal. Meaning i pick fun of them all the same. Its called joking.

If someone wants to make jokes about me because i am a hairy man...fair game.

If someone wants to make jokes about my wife being an irish new yorker...fair game.

If i want to make jokes about someones gender identity...fair game.

If you want people treated equally then you have to be ok with making jokes to everyone. Thats being equal.

I bet the dude in this lawsuit has no problem when the comedian makes a joke about trump, clinton, cosby, etc.

When making jokes everythings fair game or none of it is.

People just need to learn that a joke is a joke. Dont take everything so serious.

Its not dehumanizing at all. Its very humanizing when you treat gay people the same way you would treat a straight person for example.

Making a joke about someone is not reducing them to a joke.

Uhh, yeah it is. Not everyone is affected by it the same way but it can increase suicidal feelings or feelings that you're not "right" about yourself. If you're not sure about your identity... you can see where I'm going, right? I hope I'm being clear here.

They are basically saying its not cool to make fun of certain groups. But they have no valid reason as to why it isnt cool.

Everyone is fair game when it comes to jokes. If a comedian tells a joke you dont like....dont listen to them.

Well I get that, but making fun of a group just reducing them to a joke? That doesn't even make sense or mean anything.

Thats an issue with the individual. Not with the joke teller.

Some people are triggered by people clapping their hands. Thats not an issue for the people clapping. Thats an issue for the person whos triggered.

Have you ever questioned your identity? I did until I was 23, with my sexuality, and it was not fun at all.

That's a personal anecdote, yes, but it should help my argument.

Not everyone is affected by gluten in the same way, yet it's still being stripped out of food for an inferior product for non-existent health reason for people who don't have that issue.

No i havent.

It wasnt fun when i spent 23 months in prison. But its not offensive to me when my buddies make jokes about dropping the soap.

It wasnt fun when my wife was in a coma after a car wreck. But i can still make jokes to her about her big boobs being the thing that saved her life.

Because they are jokes.

If you cant take a joke thats a you problem.

I'm actually on a restricted diet that removed gluten from my diet entirely, so the whole "gluten free" trend is nice for me because it means I get more food! Including some I haven't had since 1999, like oatmeal and cereals like Chex.

You have no idea how much I missed that stuff.

Okay. Everyone in my group of friends told me to kill myself on a near daily basis. My sister tried to castrate me, my family has told me to kill myself as well. Boo Hoo.

One of my buddies got in fist fights with his dad, and he had one of his front teeth completely shattered.

I don't give a shit about "Someone said some mean things" when there's far worse realities where people weren't coddled and they still came out fine. Oh no, someone made a gay joke...
