Can I RMA my GPU

Overkilled

So I bought a gtx 970 HoF and it really isnt a good overclocker. I only got a asic of 65.8 and I cant even break 10000 on firestrike

Not having a good overclocker isn't really a defect unless it's outright advertised that the card will overclock well.

No point.. If it was advertised as OCing good then RMA if not just return it and buy something else.

Jayztwocents actually just made a video which addresses this. No, trying to rma a card that doesn't overclock well is really sketchy and should be avoided.

The other main problem is that the card was bought used (at that time it wasnt sold anywhere) would that be a issue?

YES. Most warranties don't transfer from owner to owner.

This is why I never recommend a GPU based on the argument "it can OC well" - because not all boards are equal - you have a perfectly good card that can't OC. You can't do anything about it.

As long as the card can reach the advertised boost clock just fine, i dont see any reason why they would accept a RMA on the card, i had a 970 HOF myself that i sold on, it was also quite a bad overlocker with the "stock" HOF cooler. If there is nothing wrong with the card you cant really expect them to accept the RMA, i mean you could lie about it, but i would strongly advice not to do that. I have heard of other people RMAing their card just because it had a low ASIC score, which is just silly.

No xD thats basically saying that your hamburger at your local grocery store isn't great and want a refund

Shady is a way of adjusting behavior through approval. If you can return it, why not? If someone else is fine with a GPU that doesn't want to OC, they can save money and but the open box.
