Hideo Kojima retweets MGS5 fan made pic - Konami files copyright claim

Pirates who say they're pirating because of a companies bad decision were going to pirate the game anyways, they just needed some BS justification to make piracy look alright. 

You can't generalize people that pirate as I personally know many who pirate games due to the soul fact that they don't have the money to buy any games at all, so they either have to stop paying their bills and not be able to enjoy their hobby, or they skip a bill so they can play a game. And then there are those who can afford the game but don't buy it because they are cheap as fuck

If you don't have the money to buy a game, don't buy the game. You are not OWED a game just because its your hobby and you're too poor to afford it. Real life and its expenses overcome stupid games that amount to nothing in the grand scheme. Maybe those people you know should focus on increasing their financial security before spending money on games, no? 

 

No one is owed a game for any reason. Do not use justifications to trick yourself into thinking you're doing something. The semantics of theft are a grey area for some, but the fact is you're taking something you have no right to take, that doesn't belong to you on any level. 

 

If the choice is between not paying bills that actually matter or enjoying your 'hobby', get a better hobby that doesn't put your monthly payments at risk just because you want to play the latest AAA game.

That's like saying pirate it: yes it doesn't gives money to Konami directly, but actually it generates more interest and notability for the game which translates into more sales. The better option is not to support it at all and let it die out instead of hyping it up by getting a pirated or a less than legitimate copy.

If it was manually checked then how did it go through, they don't own the fan's art, or is it the client filing the glaim that does the checking. If so that's fucking stupid. It should be someone not part of the group that filed the claim who verifies it.

Yes it is stupid, copyright and trademark law is quite stupid. And companies are usually afraid of the bigger guy with the more cash to sue more than who's right hence youtube and twitter usually side with companies even for blatantly false claims.

Your question is a false dichotomy based on the assumption that getting a game, which is purely a luxury item, is a necessity.

I know it wasn't directed at me, but my answer would be: I would look for a way to engage in my hobby more cost-efficiently, i.e. wait for prices to drop, buy things on sale, if one game is too expensive right now, play another one.
