Future Motion (manufacturer of OneWheel electric skateboards) suing third party "battery unlocker" chip

Summary

The company that manufacturers the popular single-wheel electric skateboard "Onewheel" filed a lawsuit against "bad faith actor" JW Batteries today. JW developed and sells a chip that allows the installation of an aftermarket battery for most Onewheel models. The JWFFM chip piggybacks on the battery management system to provide accurate battery readings and disrupt the "pairing" of the BMS and main controller. The suit claims that JW is circumventing core safety features and copy protection of the board, as well as violating some trademark law. Future Motion also states that they believe JW is acting "in bad faith" by alleging the FFM in JWFFM stands for "F*ck Future Motion". Some in the community are regarding this as a continued and blatant attack on Right to Repair by Future Motion.

My thoughts

As a Onewheel owner (both the Pint and XR models) and heavy proponent of Right to Repair this story really gets my juices flowin. FM has gone out of their way to make their boards unmoddable with things like controller and BMS pairing, but I don't think that JW really has much of a defense here. Their argument that they are just the little guy and this is a blatant attack on owning your board is undermined by their attitude and marketing.

 

FFM is a very common saying in the community and nobody is in the dark to what it actually means. There's certain aspects to the chip and JW's marketing that has always seemed sketchy to me. As the lawsuit points out, they've straight up used the XR part of the Onewheel XR logo in their JWXR logo. The price of the chip is also strangely high at $250. It's hard to tell how complicated the device actually is since all of their photos and installation videos never show the populated side of the PCB. For all we know it's a simple microprocessor and some voltage regulators.

 

Is this an attack on Right to Repair or just another modchip made by an angry third party? Maybe a little out of A, and even more out of B.

I could be wrong, but if this is true and it is widely known then this argument would hurt their trademark claim.

Aside from the Trademark infringement, which I think could very well be a thing against them, I think the rest of the case likely is a whole lot of nothing.  [And even then, the trademark one I would have to look into a bit more.  While there is obviously confusion and a certain amount of trademark infringement if the stickers were the only things violating that then I don't know if they can really ask for much damages...because in this case they would have to show damages resulted from the trademark infringement].

 

The general counter defense to a lawsuit like this would be as follows (or at least with my limited knowledge of law...which admittedly isn't too much).

- The anti-circumvention is used for access copyrighted works.  If they circumvented the tech, but only are using it to allow a battery to be installed then they really aren't circumventing it to access copyrighted works (just interface with it), which from my knowledge wouldn't violate the anti-circumvention parts of DMCA.

-The Computer fraud and abuse act: I don't think this applies as what they are accessing the chip with the owners knowledge...it doesn't matter that the controller communicates with JW, the controller is what is being access and the controller is owned by the customer not JW.  IF this were to be passed and awarded a guilty for this section then you have effectively killed all right to repair because all a manufacturer would have to do is add some online feature in relationship to all components.

- Not sure how you would defend the trademark though, it seems as though it is the only solid one.  You could try arguing that no one really would confuse the two, and you could argue that its used as a descriptor so one knows what they are getting works with a product at a glance...but I don't know.

The precedent set here (Impression Products Inc. vs. Lexmark International Inc) should pretty much shut down this lawsuit, I’d imagine.

Wait but wouldn't these 3rd party add ons get future motion more sales? They don't have a competing product either and since it's a 3rd party mod it will void the warranty and future motion doesn't have to worry about any safety concerns

Oh you haven’t met FutureMotion… if you replace the tire on your OneWheel and mail it to them for warranty service (I think it’s $80 each way) they’ll take the third party tire off and put a stock one back on and then complete your warranty service.

 

Most users of these devices just forget about the warranty after the first few hundred miles and take them to third party repair shops.

these batteries used to work without the need of a chip, FutureMotion released firmware updates that bricked any customers existing batteries functionality. The boards still worked but they made it so that the the controller reads amp hours and once it reads the number of amp hours that a stock battery has it shuts off, doesn’t matter if there’s 2 times the amount available left… just shuts off

I do hate this kind of thing. I recently replaced the cells in a friend’s mountain bike battery. After all, they were just 18650s. I had to re engineer the battery management for just this reason, it had locked out the charging as it saw a different size pack than it was programmed too. It had Sony 18650 cells rated at 2600mah and I put some new Sony cells in rated at 3000mah. A new pack would have cost around £400 for cells that add up to about £45. I find this practice abhorrent. If I need to replace cells for a reasonable price in a product I own then it has nothing to do with the manufacturer when the are trying to charge an exorbitant price. I don’t mind it so much if a manufacturer are selling for a reasonable price, but so few do. Instead they do everything they can to force you to either create e-waste or pay them a ransom to repair the product.
