eBay buyer protection doesn't cover digital downloads/keys.

Could you let me know where you've seen this?

 

As I understand it, eBay buyer protection only covers items in their money back guarantee, which digital goods are specifically excluded from.

If the seller sells a digital good and sends it to the buyer via email, buyer can simply say he has not received the email. And as technically digital goods are against eBay rules hence message delivery does not count, buyer gets refund.

Again, where are you getting this information from? 

 

Digital goods are allowed to be sold on eBay, so long as the seller meets the criteria set out by eBay. As far as I can find, eBay does not specify how the goods must be delivered or specify ways in which they cannot be delivered. 

 

I'll agree that the majority of sellers either don't qualify to sell digital goods or list them incorrectly (ie. not as a Classified Ad), but they are allowed to be sold and there is no protection for the buyer under eBay's Money Back Policy or their Buyer Protection, even when the seller meets all the required criteria. Maybe you can get your money back through their automated systems, or they just side with the buyer most of the time (which they normally do), but you are not covered by any of eBay's protection policies.
