I could be wrong but I think Linus has said that items sold through the store only have a limited warranty from Linus himself as review samples will not/may not get support from manufacturers.

Usually I would agree with this but recently all the new tech is bringing is PPW improvements. if you can stand the power bill older tech at 95+% the computing power seems a good buy.

Do it. 3970X is beast. Give it a nice overclock and your set for a few years (depending on how often you upgrade.)
Only downside is the newer chips have better IMC, your looking at 1600MHz/1866MHz and if you lucky 2133MHz.

I've already had my 3930k at 5ghz, but it took a stupid amount of voltage to achieve.  (1.55v) Temps were still fine, but it degraded a bit and now needs ~1.565v to hit 5ghz now.

 

If the 3970x in store can hit 5 at ~1.425-1.45 I'd be happy with that :3
