I believe it should get removed or flagged. Because the effort they put in getting the results. If I did a report on how water cooling could help with the temps, someone can't take it because it's my work and it took me time to do it.

Kinda weird how he doesn't use his own benchmarks.. (since he has the card itself and I would guess some more GPU's too?) but I would see this as fair use.

Would be nice if he at least gave some credit though (even though that doesn't change anything about fair use)

What I forgot to mention, is that if you someone else's information or a part of a video, you always should at least mention their name or ask them. If I found anyone big or small on YouTube then I'd ask them to remove it because they didn't ask for permission to use it. I don't want people stealing my work so they can gain views for it.  Because It's happened to me and to my channel and I don't want it happening again.

I think for fair use he has to give credits to original creator and not claim that it is his own. From the video it seems that they are his own benchmarks, so in this case it can be argued that he is breaching the fair use terms.

Due to the commercial nature of Youtube adsense, the non- trans-formative nature of the way the screenshots where used (there was no modification or alternative interpretation of the results) and the fact that the video can be viewed as directly competitive to LMG then fair use does not apply and LMG are well within their rights to apply a copyright claim against the video.

 

It's up to LMG if they want to pursue this of course.

Exactly! I've had an issue where someone stole my hole video on how to install a GPU, I've put a watermark in the video and he's blurred it out. >.> But the video has been long gone. :)

One would say its their own fault for not using logos in graphs. I mean every other bigger name uses them, TTL is using both watermark and logo.
