I saw this while on the interwebs so here it is

Mr White lost all of his contact data and photos when his phone got serviced at an Apple store but what shook him and his wife the most was the loss of their honeymoon photos from 2014

 

This is another great example of the underdog winning, which i like.

So the guy didn't back up his photos, his contacts or any other data and he gave his phone to Apple to repair?  Most tech companies advise you to backup your data before sending any device with data storage capability (phones, computers, digital music players, etc.) back for servicing or repair.

 

What would he do if he had lost his phone instead?

 

I don't feel pity for the guy, he deserved to have his data wiped.

Yeah 2000GBP is not going to replace those photos, depending on how precious he considered them.

Judge who ruled this is retarded, and likely was biased against Apple, which means he probably should've recused himself. 

 

Per The Mirror's article:

 

The Mirror reports that a lawyer for Apple laid the blame at White’s feet, noting that by coming to the store for repair service, “he made the decision to hand the phone over to them knowing the iPhone was not backed up and the pictures and videos were therefore at risk… It is something we inform all customers of before they carry out any action on phones or iPads.” Regardless, the judge found that Apple’s “employees were negligent in the treatment of the claimant’s telephone, causing the claimant loss of photographs of particular sentimental value and the loss of all his contacts.”

Doesn't Apple backup the data on the phones before repairing? My cousin just did this the other year and had her stuff backed up and restored after they were done...

But that doesn't change anything. Logically, this case has no place in court since Apple themselves say that they recommend users back up their data before sending their device to be serviced, and are therefore not liable for any loss of data that occurs because they mentioned the terms beforehand. It's entirely his fault, and he should be held liable for it. If he wanted his data to be safe, he either would have had to learn how to back up data himself or ask someone who does. There are many resources available to learn how, not least of which is the Apple store itself. This case should be re-evaluated by a judge who isn't idiotic. Whether you dislike Apple or not, you can't argue that this decision is unfair to them.

 

In the end, why should Apple be held liable for something after they recommend a certain course of action and state what could happen if said action is not taken? They state what is expected of themselves and the user, and backing up data is an expectation of the user.

the man is 68 years old, if the staff only used terms like back up your data etc he might not know that this means pictures and contacts and also may not know what back up means in a technical sense.  as such the staff have a responsibility to make sure that the customer understands.

What's with people taking pictures.. and never actually doing anything with them and then complain when something happens to their phone and they lose everything.

Where was this ruled? I could totally see it happening in EU since they have such a "hadron" for big American companies like netflix, Microsoft, Intel, etc. maybe I'm wrong tho.

I would not say he really won he asked for 5k got 2k and I highly doubt Apple even really fought it prolly just paid it due to not really worth there time.

I'm pretty sure they explain well what happens when you give a phone in for repairs. The guy didn't pay attention and was silly enough to keep the only copy of important pictures on his phone, he did this to himself.
