NCIX OWE me 275$ for a refund. I've contacted them since late October early November  and they didn't answer yet. I recontacted them less than a week ago and still no answer. This is aboslute Fraud. I know they are bankrupt but it's not an excuse to keep my money. Does any of you know how I can deal with that? Thanks

Well, it actually is an excuse.

While I don't know the exact rules applying to insolvency in Canada, usually insolvency means that the company doesn't have to honor it's debts for the time being.

And depending on how the laws are in Canada, then you can claim your $275 at whatever entity is administrating the liquidation.

But good luck getting your money. You'll be one in a long line of creditors and usually banks are far ahead of you in line.

 

Alternatively, you could talk to your bank or card service and ask if they can take the funds back.

But if the purchase was made in October then the chances are probably slim for that to be possible.

You can wave your money goodbye. The creditors that they owe the most get paid first from whatever is generated from auctioning off the remaining stock. Individuals like yourself are pretty much SOL, unless Canada has some sort of buyer's protection in this regard, which is doubtful.

usually it means you get nothing.  It is the declaration business/people make when they can't pay their creditors (which in this case is you).  I know the sting of it though.  I did a job for a firm a few years back,  I worked through the night in the city to get this job done before open hours and then the cheque didn't come, called and they said next week the accounts are being settled.  I'm sure what they meant by that was next week we are filling for bankruptcy so you won't get anything.    We just got put into a list of people who were owed money and got nothing.     

 

The things that really rubs me (and I am sure it does you too) the wrong way is that they knew it was all going pear shaped and still offered you a refund taking back the goods. Same with my business, they new they were never going to pay and contracted me anyway.

Grammar and spelling is not indicative of intelligence/knowledge.  Not having the same opinion does not always mean lack of understanding.

Since late October? After 2 or 3 weeks of nothing, you should've just called your credit card company/bank and issued a charge back. You've waited too long. You generally have up to a month after you've paid with these kind of things, past that, you're quite often SOL.

You could try to argue your case with your bank/creditor, but it's unlikely to have any effect.

I had a local Dutch store where I always went to, they eventually also filed bankruptcy.

Luckily one week before that I picked up my parts, otherwise I'd lose them and they'd be auctioned (There was an auction, I even partook in it)

 

In your case, depending on local laws .. but most likely .. SOL wave the money goodbye..

It isn't fair, at all. But life isn't in general, as @TetraSky already said contact your bank .. maybe they'll make an exception (Just stay polite, they tend to be nicer if you are.)

Filling bankruptcy is a way to absolve from debt, that is why it is called bankrupt.

Nevermind all the reasons why you can't get your money back. What did you buy and why are you returning it? I'm morbidly curious.
