Rights for a refund

So after I delidded my cpu my motherboard died,

when reseting my cpu to try and fix the problem some of the capacitors on top of the chip where knocked off 

 

I took my pc to a local shop and they confirmed my board as dead 

 

but it said they could fix my cpu

 

the cpu was fixed by the guy taking apart a i3 cutting the capasitors off of that and soldering them on to mine.

 

he charged me 40 for the i3 and 55 for the soldering

 

after he rebuilt my pc with a new board

i took it home and the chip died after 20 mins

 

i took it back after the bank holiday weekend and he told me the chip was dead.

 

i mentioned a refund and he said no because I could have taken the pc home overclocked and killed it my self

 

when he installed the board and chip he set it to auto oc with the Asus profile to 4.6 at 1.31v which he even showed me 

 

so I don't no how he can say I took it home and killed it my self though overclocking when he already pushed the voltage further than I ever had 

 

what rights do I have for getting a refund on the work he did to my chip which didn't work 

 

I feel he should refund for the soldering and the i3 he charged me for to fix it

Well you go to sketchy physical local shops you are likely to face these issues, the only way you can demand a refund is through the legal route which isn't worth it and reason why he does it any ways.

File a complaint with local consumer protection authorities giving your argument as to why their job was terrible (you can't just solder caps from one CPU to another, you have to watch capacitances and you have to make sure you don't solder an inductor in the place of a capacitor). Or you could sue. Either way it'll take a bit of effort but you could walk away with money

The difficulty here is proving things to get a good outcome for yourself. What was offered/claimed is going to be hard to argue, so I will put that to one side. Since the location is stated as England, if you decide to go to court, there is the small claims court which minimises costs.

I know. OP stated this in an old thread. If the tech soldered the heatspreader, he could be the cause of the malfunction as well since Intel doesn't approve of their CPU's using solder in place of TIM.

I would anonymously call that shop and ask them for some kind of repair and after that ask them how long do they give "their" warranty that it will work after they repair the thing. If they say any kind of warranty i would sue them

Reading comprehension is an important skill.  The i3 was used as donor parts for his main CPU.

Usually 1 week or 1 month depends on the issues.

So if your cpu goes to shit again after u bring it home we will repair it for free and if its cant be repaired we will give u a full refund.

You may have to pretend and call them if they provide a warranty for fixing a component.

He didn't though. If i where to give you my 5820K as it is it would run at default clocks unless you OC'd it yourself. 

 

The CPU does not store an OC in anyway.

Where I live, if I delidded my CPU and damaged it, any shop owner would just tell me to get a whole new CPU or be SOL.

You delidded and voided your warranty on the product. You took the risk seeking help from someone unqualified to perform repairs on the product.

Yes I did but as there a shop they can't tell me they have fixed it 

and then it breaks 

if he wasn't confidant he should have said no to it and not touched it

That's a profile on the motherboard BIOS, not the CPU. The CPU does not store OC profiles.
