It's a tight competition between the stupidity of the name, and the stupidity of prosecuting him. And given how many SSID joke names are out there, I think the latter is winning. The whole story is about wasted law enforcement resources. Next time an attack takes place, don't be surprised if they tell you "sorry, we were too busy prosecuting SSIDs".

Sorry but that defense doesn't work, he should've known better than to use a name like that. That's like people making fake terrorist threat to airports "just a joke!". But law enforcement can't just ignore a possible threat, because if they did ignore them, one day it will be real and no one will react to prevent it.

Wasting everybody's time on a fake threat is not just a "joke", it's criminal. In his case, even if it was just his wifi's name, it can still be seen as a threat/allegiance to the terrorist group. He should consider himself lucky to have only gotten 3 months.

I'm trying hard to see SSID name=bomb threat. No success so far. To begin with, home networks are meant to be internal to your house, even if the nature of wireless communications makes you EM spam everyone around you. Hence, it could be argued the name was only meant for internal consumption. A public bomb threat, even if fake, is, well, public. You purposely send a threatening message to others, and is comparable to using toy guns for robbing.

At best, the SSID name could just lead to some preliminary inquiries about the owner. It's not like a terrorist cell will hang a "terrorist cell" sign under its door bell, but well, I guess you have to check anyway. But a sentence for "directly provoke acts of terrorism or to publicly praise one such act"? I'm still waiting for any evidence that he provoked o publicly praised any terrorist act...

 

I wonder whether the person using "FBI_surveillance_van" will be prosecuting for police impersonation... 9_9

Btw, you are confusing France "state of emergency" law, which does indeed enable some scary, but specific, police state practices, with "martial law", which no, it's not what France has.

Actually, CSIS only operates externally and does not engage in domestic investigations.  For a threat made from within Canada, the responsible agency would be the RCMP, specifically their National Security Criminal Investigations Program.

from state of emergency to martial law there is but one step

from a legislative pov, there's no difference as the executive branch has "special powers"

 

France is "under siege" État de siège (Article 36), declared in Novemener 2015 - and what that means is military can take police powers (including prosecution by a military tribunal), civil liberties can be restricted, they can expel anyone for any reason (if you jaywalk they can expel you from the country)

Even if what he did isn't harmful, 3 months isn't much time and hopefully the guy will have learned the lesson not to be reckless with sensitive stuff like that.

I don't think he will spend any time in jail. Short sentences with no prior convictions are held in suspension, only to be made effective if found guilty of an additional offense within some time window.

You live in France and a relative of yours died during one of those attacks that happened this year. You're scooting through the wifi and find that one of the SSIDs is called the same as the Islamic state. At the very least, you would become scared shitless at that moment, even if later on you rationalized and said wait, that's probably just a moron who wanted to be funny.

 

Want it or not, at that point the damage is done.

On the actual topic itself. What a load of crap. In cases like these you at most go over as police and have a chat about what a poor joke it is. This shouldn't even hit the prosecutor's office.

From a counter-terrorism perspective you're really just shooting yourself in the foot here, as shit like this undermines acceptance of existing measures and only makes you look you're running some kind of totalitarian mind-police. That's exactly the kind of impression that only reinforces radicalization.

The fact that you can do these things doesn't mean you should

Yes you can suspend a lot of civil liberties and essentially go to town on your own populations, all completely within legality. Doesn't mean you should... especially when considering the preventive aspects of counter-terrorism.

The current problem they're having is a result of making exactly this mistake.
