For all the paranoid people out there i have been saying this for a while now and here is the proof

We will access, disclose and preserve personal data, including your content (such as the content of your emails, other private communications or files in private folders), when we have a good faith belief that doing so is necessary to protect our customers or enforce the terms governing the use of the services,

Microsoft said in its recently update new terms of services agreement.

Windows does not collect personal information without your consent. To effectively provide Windows as a service, Microsoft gathers some performance, diagnostic and usage information that helps keep Windows and apps running properly. Microsoft uses this information to identify problems and develop fixes.

As The Telegraph says, the saved data is used to "improve and personalize" each user's experience of using Windows 10, for targeted adverts via a unique customer advertising ID and to inform users of new software, security and account updates.

Microsoft privacy statement says:

However, we do not use what you say in email, chat, video calls or voice mail, or your documents, photos or other personal files to target ads to you,

You can read it here: https://www.microsoft.com/en-us/privacystatement/default.aspx

It is important to pointing out that Google does the same thing with it's users. It sweeps its users' emails in order to provide them with more targeted advertising. And unlike Microsoft, Chrome web browser monitors what you visit as web pages even under incognito mode.

In addition, Apple's digital assistant Siri and Google's Google Now also collect user data in order to personalize their responses.

But if your still paranoid there is Privacy options under Windows 10 Settings panel, which you can disable anything from Windows and apps that can 'Spy on you'.

The bottom line is, if you rang Microsoft or spoke to them on chat and said you know who i am or said my name is "blah blah" look me up there reply be I can't tell your account by this give me your email please and even when u give them the email ask them what site do i use most or my favorite color or whats my wifes name they will all be like sorry we don't know that information they don't see shit all the "spying" does is helps make windows 10 base it self around you to make more user friendly experience and better adverts related to your life your like Google already does! Google read all of your emails u send on Gmail (well they don't read them there system scans them for any red flags and thats what Microsoft will do to) so if you have a 20 email conversations with someone mentioning bombs and terrorist Gmail and Microsoft would see that flag it and your email would be passed on to be watched by the government to monitor you to make sure your not a real terrorist and to help prevent terrorism, etc, etc, or drug traffic but you get what i mean. its all about user friendly experience and world safety

if they see you look at porn they wont give a fuck as long not under age shit if you use your card details they wont give a shit or record it if you want to do or by something privet and something you don't want people to know don't worry as they don't care it wont get red flagged and no one else will ready it except a robot that doesn't store conversations unless they red flag key words

I find it odd that so many people seem to be going crazy over this. Everyone on this forum that uses a PC has more than likely already had every bit of their personal information plastered all over the internet. This is just another one.

Also, as I am sure other people have said, my emails are boring as hell, mainly just confirmation of purchases for stuff so really not that bothered if they want to read that.

there only so much they can do with data as there is laws in place to prevent stuff like the data protection law if broken company's can lose millions and small company's could even stop trading so nothing to worry about that i can see anyway

Also, Windows Phone users may have noticed the "advertising id" feature in the settings menu, which you can turn off. I think it's safe to assume you can turn it off in Win10 asewll

Agreed, I even want google to look at my emails just so I can do things like typing "show my latest purchases" in google and getting a nice overview. I don't mind them doing that, it's useful for me.

Microsoft doing this is nothing new and I couldn't care less about it.

Nice try but no, we already know most email and online services, facebook, google, gmail all of them collect some data but microsoft just went a couple steps further where it shouldnt have and implemented a lot more of that intrusive data collection into windows, it first started a bit with win8, and win10 went full on spyware.

I believe our devices at least should be fully encrypted and close to 0 data collection and manufacturer spyware, everything you do, search, email, text should be private but thats just a silly dream nowdays i know.Does that give Miscroshit rights to fully ruin the OS, for their personal or USA gov benefits?no, thats the cost of "free" upgrade.

Basically theres nothing to freak out about its simply MS being scumbags, you dont like it? uninstall, or so i would if games would be on other platforms as well. It doesnt matter that others do some sort of collection too we are talking about MS here, so what now it will become a competition who collects more data and fucks privacy the most, between software/hardware corporations?

Whats next, hardware with spyware embedded ROM's that connects to internet automatically and update to servers user data?

I found this which we already know about https://jonathan.porta.codes/2015/07/30/windows-10-seems-to-have-some-scary-privacy-defaults/

And i read this comment which i find disturbing, im sure some of this stuff was in win8, and little in 7 too but not at this scale, i dont remember people complaining about 7 or 8 tellemetry and data collections spyware embedded, i disabled most of it, i never had to disable/uninstall/registry hack any data collection in previous versions.

LOL that's not even the tip of the iceberg, be sure to READ THE LICENSE CONTRACT.

Click on search>settings icon>Other privacy settings>Privacy statement

Then you will get the atrocious contract, including, between many offenses, this:

(google "Microsoft Privacy Statement" if you do not have Windows 10, and want the full text)

"Reasons We Share Personal Data
We share your personal data with your consent [...]"

Ask any lawyer. That does mean that you are giving your consent to Microspyware for your personal data to be "shared". It is a statement of fact: Microspyware shares your personal data, and you consent to it.

It does not says that you will be asked for your consent, it says that you consent to it.

It does not impose any limitation on the "sharing". Anything goes.

"[...]we share personal data among Microsoft-controlled affiliates and subsidiaries. We also share personal data with vendors or agents working on our behalf[...]"
"[...]we will access, disclose and preserve personal data, including your content (such as the content of your emails, other private communications or files in private folders)[...]"

It also says:

"Personal Data We Collect"
[...]
"Name and contact data. We collect your first and last name, email address, postal address, phone number, and other similar contact data."

"[...] the content of your documents, photos, music or video [...] the content of your communications sent or received [...]

subject line and body of an email,
text or other content of an instant message,
audio and video recording of a video message, and
audio recording and transcript of a voice message you receive or a text message you dictate"

"Contacts and relationships"

"Credentials. We collect passwords, password hints, and similar security information"

Note that it does not says that it collect the passwords you provide to Microsoft. It just says "passwords". ANY password.

"[...] (GPS) data, as well as data identifying nearby cell towers and Wi-Fi hotspots, [...] location derived from your IP address [...] a city or postal code level."

"[...]age, gender, country and preferred language[...]"

"Interests and favorites. [...] such as the teams you follow [...] the stocks you track [...] In addition to those you explicitly provide, [...] may also be inferred or derived from other data we collect. "

THE STOCKS YOU TRACK. That would be absolutely illegal without a contract.
ASIDE THE INFO YOU EXPLICITLY PROVIDE. That means that Microsoft gets the right to survey you by any means, aside Windows 10.
It does not need to survey you only trought a computer, phone, or website running Windows 10, it can survey you trough any way.

There is no opt out.

"Usage data. [...] such as the features you use, the items you purchase, the web pages you visit, and the search terms you enter. [...]"

"[...]This also includes data about your device, including IP address, device identifiers, regional and language settings, and data about the network, operating system, browser or other software you use [...]"

Worse, there is another clause that says that MICROSOFT WILL CHANGE ANY CLAUSE AT WILL.
"Changes to This Privacy Statement
We will update this privacy statement [...]"

So, by using Windows 10, or any MS product or website, including Microsoft Account or Bing (which you are forced to use each time yo do a local search in W10), you are signing a BLANK CONTRACT IN FAVOR OF MICROSOFT.

Im sick of MS apologists.

Im more concerned about the auto update which can install renable/reinstall microsoft crap at will, data collection and other nonesense that i already disabled..

LOL (not specifically aimed at you) have you done anything illegal with you pc? are you in jail? so how can anyone say there watching us?

it is literally driving me insane that people don't understand there collecting a small amount of data that is not stored just to improve your user experience and keep you safe by flagging key words to the government.

you can all hate on it now but that's life nothing has ever been private your internet provide collects data so even if your pc was fully private your internet provided would still see everything!

ye so hate on MS for what they have added this time around but don't you dare cheer for them when thanks to them red flagging keywords the help the government stop a terrorist.

I would say stop a drug ring but I take drugs so that would fuck me off if they help shut that down! O SHIT! I just mentions I do drugs on a windows 10 PC better run now my privacy has been broken and Microsoft are passing my data over to the cops now to lock me up!

What I find interesting, is that people don't trust their data to Microsoft. Ok that is fine. I have 0 problem with this.

But Microsoft, amongst all the big corporation, is the only company that has demonstrated time and time again to fight for privacy data being accessed in an non-authorized way by law without warrant. And that is why I am scratching my head on those who freak out over a bit of standard data collecting which is common, and I would argue less so, then other of the big companies, which people use their product and services.

"only company that has demonstrated time and time again to fight for privacy data being accessed in an non-authorized way by law and common sense." sorry I got lost on this does this mean they are fighting to stop and prevent people doing this?

You do realize that by "standard data collecting" what you are actually describing is that Microsoft can and will access every single byte on your computer.  Re-read what their statement actually says.

It starts with a blanket statement of collection, and only then they add very specific restrictions of what they "won't" do with it once they have it.

For a kid playing games, downloading music, or buying crap on Amazon that is one thing.  But in my household we also do our banking, taxes, bill paying, legal matters, and our insurance/healthcare on line.

Re-read their promises.  They are not describing any sort of firewall - they can and will take it all.  Once they have it they are under no legal obligation to protect it.  What happens if they get hacked?  And don't tell me that will never happen.  Ants find the sugar.

If/when they do lose your data you will have no basis to sue for damages.

Sure, they'll tell you they won't use it to sell you stuff.  But that is not a promise to not use it to sell other people stuff, or a promise not to sell the data to someone else.  Oh, they'll tell you the data will be "de-identified" but that is nonsense.  There are now algorithms that can defeat the anonymity of TOR, the same sorts of algorithms can easily re-match your identity to your data - there is too much specificity there not to.

Serious issues remain, but there also appears to be a serious effort to squelch any discussion of them.

They can only what you put on Microsoft servers. That means OneDrive.

Please read the privacy policy of Microsoft, and stop assuming things. It was written to be simple to understand for non-lawyers out there, or tech savy people.

Your data is sold to companies. It is a multi-billion dollar business. How do you think Google can offer better services to it employees, including free high quality food, accessible at each edges if corridors on each floor, done by a chef in front of you, and all, you can eat. One of the few massive numbers of employee benefits, and still have massive profits each year.

Data collected by Microsoft, contains none to identify you.

It is collected for general market research data that other companies are willing millions to get, as it is cheaper than investing on a failed product.

No, that is flat wrong.  It is not limited to what you put on OneDrive, it is anything you place on, or send across anything they define as one of their "services."

Again, totally false.

"However, we do not use what you say in email, chat, video calls or voice mail, or your documents, photos or other personal files to target ads to you..."

Otherwise how could they make such a claim without knowing that it is your data they are using?

you have a unique advertising ID that is not linked with your name or any other personal information! it is linked to your product id that's why when you change pc it doesn't follow you or if you clean install your pc it doesn't remember what u liked -_- that is said in that same agreement as well -_-

I'm starting to get gob smacked at the level and lack of understanding
