travelling to USA and Canada with unlocked(?) phone

Got couple of unlocked phones, and I visit the U.S twice a year. 

 

I'm telling you buddy no ones gives a crap lol.

Hey guys'

I am from Germany and I am travelling to the USA and Canada. I have a rootet Samsung galaxy s3 with cm11 on it and this is quite obvious. In yesterdays wan show Linus said that you can be charged for an unlocked phone and when you travel to the USA you have to pass a control where they your phone.

I am very confused at the moment because I don't really know the definition of an unlocked phone and If I can be charged therefore.
