when i have fraps running my assassins creed 2 frames shits themselves, I have a 780, 3770k and 16gb of ram, its not the only game that does this but its more noticable in this game, what is happening, is it fraps or is the game just poly optomized

Do you accidentally record with fraps and have it set to a low frame rate?

thats what i meant i am recording but its not at a locked frame rate

Welcome back. As @AlwaysFSX said, is your framerate locked? Apparently, Fraps is known to be hardware hungry.
