Annoying ebay seller

"Yessir please do , my brother is in the ICU in Naples Fl downtown he has been in critical condition I Don't know what's going to happen this happend and on top of that I'm in the process of removing my son from the home we lived in before with my wife because I caught her cheating on me and using drugs so I have been getting police escorts 3 times this week , to get my stuff out of the house . But the first day I left her Sunday September 2 the only thing I brought was my son and his diaper bag my wallet and put him in the stroller and got outta there . And now this with my brother , I can't understand why this is happening all at once but I'm sorry about the delay and if you look at my EBay record I have an immaculate reputation up until September , but I'm trying my best to get everything else shipped out to my other customers also ."

Almost certainly fake - all of that happening all at the same time?

 

Not only is his Brother in emergency care, but his wife also just cheated on him and is using drugs and he needs to move his son?

 

Anyway, assuming it's all real - he still has to abide by the terms of sale. If he cannot, he should cancel the sale and re-list the item once he's able to handle it.

 

In terms of you - you're still covered by buyers protection.

 

What exactly is the issue? Is he not shipping the item, or what?

it is almost 9 days after when he said it would arrive and he is saying he will ship it soon

At this point I would just open a dispute with eBay and ask for a refund and cancel the order.

1. Do NOT message him outside of the ebay message center. Those are the only messages admissible if you open a dispute

2. It's ok to wait  alittle. I think you can wait up to 180 days from date of payment to open a dispute on paypal, but only 30 pays from intended date of devilry on ebay. PLEASE DOUBLE CHECK THIS. He could be stalling. 

3. Make it clear that you either need the item or a refund and set a deadline, nothing more. 

4. Check with ebay support for the policy with this over call maybe and ask them the course of action that you should take and when. This is probably worth your time to do so you know what the officially supported actions/deadlines are in the future. Then reply something like 

 

Dear mr X,

I empathize with your situation, but since I cannot verify any of this, unfortunately I need to request that I either receive the item or a full refund by [date] or I will open this as a dispute. If you get me the item or the refund by that date, I will not open a dispute or leave negative feedback. 

 

Sorry, about this. I wish you the best

 

 

 

Now, for frequent ebay sellers, not getting negative feedback is more important than perhaps any site, and a dispute opened, while silent and not shown to the buyers on the front end, really hurts their account standing even if the dispute is ruled in their favor. I once had a seller threaten me for opening a dispute! 

So, in my opinion, if he has a large store and a large history, he wouldn't have made it this far without delivering or refunding. If he wants to keep all that, it's actually in his interest not to fuck you. Never promise positive feedback for him resolving the situation, just promise no negative feedback ie leave none. Not neutral, just leave none.
