Ok so i know that z97 is kinda nessacary for OCing devils canyon and boradwell when they are released, but can i OC an msi r9 290 on a h97 chipset mobo?

CPU-i5 4690k 4.4ghz @ 1.190V, MOBO-MSI z97 gaming 3, Cooler-hyper 212 evo, GPU- r9 290x asus directcuII (-37Mv), Storage-120gb v300(switching soon), 1tb caviar blue, CASE-Red/black h440, PSU-Antec TPC 650.

Yes, you can. The motherboard chipset only really limits northbridge OC capabilities, not the southbridge.

wait what.... i thought the chipsets replaced the north bridge and the south bridge o_0 am i wrong?

Chipsets can limit southbridge types and (I think) bandwith, as seen with AMD's FX series (PCI-E 2), but overclocking capabilites are not limited. They are judged by the chip itself, not the motherboards PCI-E slot.

No, the southbridge (GPU, SATA etc.) is part of the chipset, but the chipset cannot limit overclocking capablilites of a GPU. It can, however, the GPU (or any other expansion card)'s socket type and bandwith.
