Clcoked the same, 9700k and 8700k are nearly identical and differences are not perceptible

You say that but

You say that but in most benchmarks I've seen the 9700k is outperforming the 8700k, also i am not taking into acount the mobo and ram when i put my spending limit so there is no way I'm going 3600. I'm trying to get a better experience at 1440p as close to 144hz as i can.

Tl;DR: I'm looking only to game, I'm currently gaming at 1440p 144hz and since I'm currently with a 6600k cpu and a gtx 1080 I want to upgrade cpu, what should i upgrade to? I don't want to go higher than 400 bucks on the cpu (so 9700k/3800x max)

Here is my current setup:

This is my first and current pc, I haven't really kept up with the current specs and with all the hype team red is having I thought I would easily just move into the 3700x as my next upgrade. But today I watched Steves review of the 3950x and saw that even the 9600k is beating it(the 3700x) in gaming performance. so now I'm completely lost on what to buy, Only thing I do know is that my cap is around the 9700k or the 3800x taking into consideration i need a new mobo and new ram anyways, which cpu should I buy?

You wouldn't need new ram with the 9700K.  Performance isn't affected by slower ram as much on intel.

If you ONLY GAME then this would be the best bang for the buck.

You could go Intel specifically in your scenario since you have slow ram and Intel doesn't need fast ram (as much) as Ryzen does.

An 8700 nonk + your cooler would perform the same as a stock 8700k, and if you pair it with a cheap b360/365 it should perform as well as any of the present Ryzen chips at gaming.

$300 + $80 + reuse ram ($380)

Otherwise, you'll want to spend $200 on a Ryzen 5 3600 + $150 for a decent b450 + $100 on some fast 3600 ram ($450 total), or $310 on a 3700x, $100 on 3600 ram, $175 for a quality b450/x570 (total $585)

I recommend against the 9700k because no HT in 2020 is silly
