I figured it out. windows has it as a virtual disk for storage spaces, not even using ubuntu installer and in ubuntu through gpart, or using a windows installer and formatting the drive or diskpart clean/clean all could bypass this. Powershell there are commands to do this. Not sure why windows had such a strong hold on the drive that.
