Lock Pick Legality?

I have found a new hobby of lock picking but many people assume like the word hacking, all is bad. I know the boundaries and not to do it on things that aren't mine but it's very fun to kill time and when consent is given I can help people who lock their keys in a closet and so on. Anyways it would probably always be in my back pack which I take to school so if they every searched me could they incriminate me for it?

Just keeping this here as a It's really based on how you use them. In most states having a set in possession is perfectly legal.

almost everywhere in the US, lock picking tools are legal to own, but illegal to carry, unless you are a licensed locksmith. In some places its actually a felony to be in possesion of "burglary tools" some states require proof of intent to charge you, others dont.

that being said, i also keep a set in my car and another set in my pack. they've come in handy many times.

 

look up your state and local laws before carrying them.

That doesn't really mean anything. If it's a crime to carry lockpicks with you in public without a locksmith license, then you are actually committing a crime. Same way in countries where it is illegal to carry a gun, it's not overlooked until you kill someone, carrying it is also a crime.

Majority of states are fine as they have to prove criminal intent, which you (presumably) don't have. I would maybe carry some practice locks with you as well (the clear ones you can get, specifically designed for practising), both to practice with and to hopefully show it is genuinely for a hobby.

yea there is such a thing as a lock pick license. When I was a kid I dont recall anyone ever getting in trouble for lockpicking, we use to pass padlocks around on the bus and pick them for fun. If you throw your tools in a bag with non-lock picking tools like an electronics repair set then you have will have a valid excuse to carry them.

one of my best friends was a locksmith. so i learned how to actually pick locks incredibly well.

only really shitty locks like Kwikset will open like that.but when you start getting into Schlage or anything with false pins, good luck.

For anyone in Australia it is not illegal to have lockpicks,  However if you don't have a valid reason for carrying them, (I.E you are on your way to a car or premise you have lost the keys to but have the right to entry) you can be done with carrying to tools with intent.  It does not have to specifically proven for charges to be laid, You'll ave to argue that with the judge.  

 

Example.  lockpicks in your toolbox would be fine and lockpicks in your car would be safe.  But carrying them to school or in your backpack or in the street with no other tools or gear would be incriminating.

That's saying that a lockpick is illegal to carry if it has been used in a burglary or theft, right? 

 

Like if you wanted to, you could say it's illegal to carry a cricket bat because it can be used to smash windows or carry a credit card because it can be used to go behind the bolt of a lock and open a door or carry snips because you could cut a fence open.

If they did you could simply go to court and they would have zero proof of intent. Checking security cameras or asking people would result with nothing suspicious or people saying it's your hobby.

Like if you wanted to, you could say it's illegal to carry a cricket bat because it can be used to smash windows or carry a credit card because it can be used to go behind the bolt of a lock and open a door or carry snips because you could cut a fence open. 

But lockpicks are designed to... well, pick locks. A credit card's primary use isn't to open locks and you can be arrested for carrying sports equipment without a genuine reason. Someone carrying a baseball bat without a ball can be arrested for carrying an offensive weapon (obviously, that greatly depends on the circumstance). 

 

Technically, the law relates to items suspected to be used in a crime. As such it can apply to hammers, crowbars and such as well, but the only reasons that will really be accepted for carrying lockpicks is if you're a locksmith. If you're not, you're basically carrying them illegally as their primary use outside of a professional lock smith is going to be illegal. I believe even picking a lock belonging to someone else, even if you have their permission, is still considered illegal and should be done by someone with a licence. 

 

There aren't actually any laws referring specifically to lockpicks (at least, not that I can find), so they're covered by laws that are generally used for items with many uses. For example, there are many reasons to have a hammer with you, but not really many (or at least, not many that are acceptable) for carrying lockpicks, essentially making them illegal to carry outside of your residence.

I'd expect they'd just confiscate them, give them back at the end of the day and tell you not to bring them in again. You could try to argue technicalities all day but it's really not worth the trouble if you ask me.

If you're a hobby lock picker, why do you need them out in public on your person? Surely that's something you do at home. I guess saying you're going to a friend's house to practice together could be a reason, but fairly weak from the perspective of a police officer. 

 

Well, it is fairly old. And a lot of (UK, at least) laws are pretty shitty and vague. It's partly necessary as the more specific laws get, the more loopholes can turn up as a result. 

 

Speaking of which, I've been trying to figure out the laws regarding having coloured lights on a motorcycle helmet and motorcycle. The laws are all over the place and there's nothing concrete other than basically not being allowed red lights on the front and basically no blue lights (because emergency vehicles). If you start looking into specific laws or a somewhat niche area, such as lockpicks, you'll often find there is no definitive answer and a lot of the time it comes down to presumed intent and some common sense. Given the primary use of lockpicks is gaining access to something without a key, it's pretty hard to argue a valid reason for having them on you.
