You can get cracked versions of Call of duty 2 and Call of Duty 4. Many people still play those games, you can even play multiplayer in cracked servers

Depends on the game. There's a lot of games from the 90's that's classified as abandonware and technically legal to obtain if the copyright holders are no longer in business.

Just because you're not in the business anymore doesn't meant your copyright expires. Not to mention a lot of companies may have been purchased and thus their IP resides with another company.

Actually if there are no company behind to renovate it the copyright would expire after 25 years and that is the case of some really old game.
