It's gotta be stolen or something. There's no way he could make money off of it. I'm sure if Nintendo can't even make it for $30, but who knows those Japanese know how to cheap out pretty hardcore.

well, that depends, if you knew the unit was stolen, and the unit was reported stolen, Ex) arrived scanned @ European shipping center & not scanned @ American, Well, probably questioned by the police & the unit taken and used as evidence against the seller

I believe in the us, that technically makes you an accessory to theft. Although whether or not you actually knew/had any way of knowing it was stolen could get you out of it.

My dad works for Walmart Transportation and they've arrested people who work in the warehouse area. They've stolen game consoles, ipads, apple stuff, and so forth.
