No Preserving Abandoned Games, Even for Museums and Archives, Because All "Hacking" is Illegal Say Publishers

And with our speeding case:

You either are speeding, or you are not.

Same thing.

And the smoking example is pretty good. Smooking can cause lung cancer but not necessarily.

Same thing with hacking and piracy. Hacking can lead to piracy, but not all the time, and saying that hacking = piracy is wrong. Piracy is a possible result of hacking.

I'm not saying hacking is piracy. Rather that piracy is a direct result of hacking. Otherwise piracy wouldn't coexist. In my books it's light on the term as defacing the internet is where the true definition lies.

But you can pirate without hacking.

You can, although it all starts from someone hacking up a binary.

Was looking for GTA 1 & 2 today. They're no where to be found. No way to download legally for free or even pay for it ! I'll torrent that shit out.

But seriously, can't they just use common sense ? It's like everybody sees what's wrong but the game publisher...

Yup, it's sad really.  Lots of old games just aren't available anymore.  Even DHTML Lemmings has been taken to court IIRC, and that's a complete re-creation using a different engine.

All hacking is associated with piracy? So Anonymous are pirates? And Lizard Squad are pirates? Are you fucking kidding me? This is way beyond stupid.

All hacking is illegal eh?

NSA is in trouble then.

The laws are in place to protect the companies and government itself, not you the citizen is what I'm getting.

Damn you found their secrets man.

"We don't want these games preserved, because we then wouldn't be able to sell them back to you.....for some reason"

But then we'd still need the hackers to get the games running on modern hardware, get online working and to fix all of the game breaking bugs.

I'm shocked that Valve still let publishers get away with selling broken games on Steam.

Gave Dev response: "Oh but that's not hacking, since its our game"

This would never hold up in court, as it is 100% legal to "hack" a game you purchased, as long as you are not distributing it or profiting on it without the consent of the developer (licensing). This falls entirely under Reverse Engineering, which is currently legal in the USA. It is also legal in Europe but only under strict circumstances (You are not allowed to create a competing product out of the knowledge gained from reverse engineering).

If you were to modify the code you obtained through reverse engineering only improving on what already exists, it would be classified as Code Refactoring, which as far as i am concerned, is not illegal anywhere. As long as you are not profiting from it, or potentially hurting the owner of said code's profits from it, it is not piracy.

This would be like saying i can't fix my 99 Chevy Suburban because it would harm Chevy's profit because i didn't buy a new truck, or pay their certified mechanics to fix it. If i paid for a video game, and i improve the experience of said video game for myself, it is not illegal.

It's not but it can be directly related. Cracking binaries is another form of "hacking".

It can also be directly related with legal backups.

What about that time a well known Japanese publisher asked for a copy of a game because they lost their's. If they hadn't had kept an illegal copy they would have been in the sh*t.

Companies wont even sell these games anymore. It does not matter at all. Its like saying a car collector should not repair a Ford T-model because Ford dont sell cars like these anymore. What

They already gave those out free at one point, so it doesn't matter

This actually goes in hand with another article recently posted, talking about how humans are not preserving data at all, and future cultures will have a difficult time piecing together the events of today in the future.

It's sad to see, actually.

if you have to insist you think for yourself, i'm not going to believe you.
