Slowly buying parts for a new build. I have an i5 9600k in my cart ($240 USD) when a local listed a ‘new’ i7 9700k for $300

the question is would the 9700k be better for gaming and is it compatible with my asus tuf b365m motherboard and 1k Corsair power supply (those two are already purchased

Unlocked CPU on a board that does not support overclocking, and then a PSU that's good for 2 high end GPUs in the same system (i/e/ overspent on it). Something's defo gone wrong in this build

The 9600K is straight up just a bad purchase at this point in time as it already struggles in a variety of CPU intensive titles which also leads to it being too expensive for what it offers.

The 9700K is a good CPU but, again, there's not many reasons to go for it when there are better options out there for the money, like the Ryzen 3700X. Also, the board you have does not support overclocking, so it seems like a waste to go for a K chip anyway. If you have the option to return the motherboard, I'd strongly advise you do and go for an AM4 build - not saying Intel's bad or I'm some AMD fanboy, it's just that Coffee Lake is an objectively worse option compared to Zen 2 for many reasons.

I'd get it over the other one for sure. It's a small increase in price to get an extra 2 cores. You can sell the motherboard to be able to overclock.

If you can return the PSU I'd do that too since 1,000 watts is completely unnecessary.

You can get a 3700X and an Asus TUF X570-PLUS for around $450-500 and get most of the performance of an i9-9900K. You'll also have a really good upgrade route with that board, supporting up to a 3950X and very likely even the upcoming Ryzen 4000 chips.

If you go this route, opt for 3200/3600MHz memory, as Ryzen really benefits from fast RAM.
