Get a 390 instead of the 970, it performs better than the 970 in almost all games at 1080p and 1440p

Let me flag the problems,

you get a unlocked motherboard with a locked CPU, If you don't have any plans on overclocking, the stock cooler is perfectly fine.

the future proofing option would be to get it anyway. Just cause he doesn't want to know, doesn't mean there isn't the possibility in the future. And if it ever starts showing its age in the future he could overclock it then before having to shell out cash for new components.

I see your point. I will tell him about this. On another note, so far he wants the GTX970 G1 because of its overclocking opportunities and power consumption/heat compared to the R9 390 and he also likes Nvidia features. I will have him look at both sides from AMD and Nvidia perspectives.

Just make sure he doesn't go Nvidia because he believes the power bill is twice as much BS or all the 90 degree BS.

No he doesn't care about the cost of power consumption. If going nvidia can spare him an extra 50$ on a power supply + overclocking advantages however that would be a benefiting factor.

This here. I prefer the green team and normally would have chosen a 970, but some people here are extremely anal about that

Well I do admire the green team compared to the red team however I am not a fanboy because I consistently have heated discussions supporting both amd and nvidia. Anyways, I tend to stick with nvidia due to adaptive vsync, geforce experience, and the new MFAA for 900 series, which I never new about even before I bought my card. I was upset when nvidia pulled that 970 memory con but that doesn't change the other factors. Thats just my opinion anyways

I've had 3 data ports go dead on me and its very temperamental sometimes for no reason eg.(ram won't be working for some reason so taking it out and putting it back in fixes it) I didn't read the reviews for it before I got it and I believe I base like a 2.7 star rating on amazon...

Why not send it to them. If your board turned out faulty doesn't mean everyone's well. And don't relie on amazon ratings, professional ratings are better as people are usually more likely to place a review if they have a issue than if they had a good experience.
