Are IT guys allowed to delete porn off of recovered data?

You were asked to recover it, not look at it and delete what you want....

Well, someone dropped by and gave me a hard drive to recover some data off of it. But the recovered data (They were images) contained some porn pictures. I didn't know if I should delete them or not :mellow:

 

Anyway, are we allowed to delete such data? If they haven't specified anything about it ofc :P

 

I burnt the recovered data along with everything (Including the porn) on a bunch of DVD's and sent them to the client. I was all "Oh well :D" But I just want to know if we have the right to delete such data  :unsure:

If it is intentional it sounds unlawful, but if it was completely accidental I don't see why you would get in trouble unless you were obligated to not lose any data during the recovery. Why would you want to do such a thing anyway, what is the problem with pornography?

I had recover the data of a couple clients who were specifically interested in recovering porn that was in the disc,  in both cases were "homemade"  videos. 

 

I guess the wifes/girlfriends would not be easily convinced of letting them record it again.  XD

I dont think you should be asking us. This is something that should be outlined in your job description.

Well said, you boss should of outlined how you should do your job for the task at hand, just like the burger boy at Micky D's, he flips the patty's doesn't pinch off the fat and then decide if you should have the fat or not, does he?

 

Secondly the burger boy doesn't pre-taste your burger either. If you snoop outside your job task and you are discovered you'll probably be fired or should.

I would be sacked straight away if I was caught looking inside folders while doing a data backup/transfer.

A guy in my hometown got put in jail for 6 years because he copied data off his clients computers regardless and was caught.

Check for filesize. There's not only one way to check if something is in a folder ya know?

What if the files that were recovered were random files which were saved from browser cache or something. I always skim through pictures (If they have me recover them anyway)

Maybe I should have them to agree with some terms before starting to recover the files.

Well if it was me, I would just recover everything I can from the volume, not caring whatever is it inside. Pass anything and everything I can recover to the client and that's it. It's up to the client to delete or keep anything he/she wants since we're not them, we can't tell what's important so why bother go through the data?

If there's no CP I would imagine it's a no-go on the delete. It all depends on the local laws in your country, I have no clue what the laws are in Lebanon.

You clearly aren't. It's his data, who are you to judge if he can have it or not? It doesn't even matter if it's porn or pictures of fish stuffed chickens smoking a cigarette.

The content is none of your concern, even if it's illegal.

You are asked to recover data, and if that's his date then you should recover it.

You guys clearly don't understand the market in my country. IT guys here, don't even know how to recover data (Trust me, I know the techies of one of the biggest computer companies in the market). Also, clients don't understand such stuff you guys are talking about here. You'll get more trouble with the client if he/she didn't get her pictures which she was hopping to get. If you tell them you didn't look, they'll simply say "Why the hell didn't you look?!" If you explain to them why, they will get even more furious with you (I have been there too many times now). They're simply too stupid to understand. I have worked in the market for over 4 years now and have gotten used to what clients want(In my area anyway). IT guys here don't even have any A+ certifications (Heck even I don't, but I'm planning to submit an exam soon). You can get fired for not frauding on the job as a sales man (I have gotten into numerous trouble with my boss for that). Companies buy used products and sell them as new. The market is absolute hell.

Police Man, buy pirated software/movies/games etc. They even buy Wi-Fi adapters for Backtrack.

70% Citizens think that paying 1$ for a game is actually buying a genuine copy. We import laptops without any OS installs and install pirated versions to sell them for cheaper.

Just recently someone said his Maximus board had dead DIMMs because he used RAM which were 1.65V instead of 1.5 (That's what the

vendor said)

Now what do you think? :D

Unless explicitly asked, I would not go through my clients files. Doesn't matter about the laws, it's just about privacy. If the client was like "please delete all incriminatory data off my laptop before my wife sees it - being all porn, I'd probably charge extra and do it during the recovery process. I'm no white knight, but seriously, how would you feel about someone coming into your house without your permission and you know the rest.

I guess my morals are different to yours.
